"In August 2022, after hearing about DFW Improved on a home improvement radio show, we entered into two contracts with them for a roof replacement and interior water damage repair. These contracts were based on insurance-approved scopes following the 2021 ice storm. DFW Improved began the roof replacement project first. Following the replacement, the roof continued to leak due to their failure to replace the flashings. Despite corresponding work items in the insurance scope (confirmed later by the insurance adjuster's email), the DFW Improved salesperson insisted that flashing was not part of the roof. He threatened legal action if further payment was not made. Prior to this, they presented two identical model shingles as choices, which their own roof subcontractor on-site disclosed. Upon our inquiry via email, instead of addressing the issue, the salesperson accused us of defaming their company. Furthermore, they quoted $900 for a non-existent siding hole and estimated $25,000 for a bookcase, which their own designer valued at $6,000 to $7,000. While the roof leaking issue was still unresolved, DFW Improved began interior work. Instead of submitting the agreed supplement request as agreed, they skipped necessary steps to cut water-damaged drywall. To prevent wasted effort, we instructed workers to stop. The salesperson responded, stating that workers would not proceed with any work not approved by insurance. However, he emailed the insurance company claiming that the work had already been completed, causing significant confusion for us. During the halt period, we sent out numerous issues such as broken air pipes, cracked roof rafters, missing insulation, roof holes, missing felt paper, and a leaking roof. However, we received no response other than prevaricate explanations and demanding for money. We escalated to the DFW Improved upper manager who responded that they are their best team members and disregarded our request for an alternative project team. DFW Improved abandoned the projects and warranties, and initiated separation in December 2022. Both parties engaged in negotiations over separation costs. During this process, DFW Improved unexpectedly sent four individuals to our house, claiming to inspect texture work and demanding payment. Subsequently, DFW Improved placed a lien on our house, and their lawyer sent a demanding letter stating they would auction our house and (quote)“sue Vigorously” if payment was not made, despite the mediation/arbitration clause clearly outlined in the contracts. Under this pressure, we filed a claim in Tarrant County Small Claims Court, where the lien was placed. Later, their lawyer filed a motion to transfer the case to Collin County, where DFW Improved is based. We refused to comply with a demand for $5,000 and the confidentiality requirement during mediation. DFW Improved filed a new case simultaneously in the higher Tarrant County District Court, demanding a new amount of $59,845 and seeking to enforce the lien, providing no explanation for this amount. According to their co-owner's email, their accounting book calculated that we owed them a total of $1,260 (detailed below). During pre-mediation discussions, their lawyer attempted to justify their request for $8k, citing that a significant portion was allocated to attorneys' fees. We did not engage their lawyer to send us a threatening letter containing false statements about suing us without mediation. Their lawyer also declined $65 public mediator service provided by the Tarrant Small Claims Court. Additionally, they unilaterally escalated the dispute to a higher court. We have never been late with their payments. In fact, DFW Improved made a math error by crediting the blind work twice. When we brought this to their attention, DFW Improved spent extra time correcting the invoice, and their salesperson initiated an internal investigation. Any delay was certainly not caused by us. DFW Improved filed a lien attempting to collect the costs again, despite already receiving payment. See the invoice they submitted, which completely overlooks the $35,895.76 payment we made (supported by our bank transactions). —-------------The payment schedule on the contract has major math errors—--------- Payments for the work are due as follows: Contract Total $ 194,972.33 $ 19,497.23 deposit is due at initial design meeting.(10% of the Contract Total) 20% of the Contract Total is due at the preconstruction meeting. 30% of the Contract Total is due at start of drywall repair. ←– we requested halt at this phase and according to texas property code Sec. 28.003. EXCEPTION FOR GOOD FAITH DISPUTE; we can WITHHOLDING up to 110% of the difference between the amount the obligee claims is due and the amount the obligor claims is due. 30% of the Contract Total is due at start of countertop/trim installation. ←–we don’t even have any work for countertop 17% of the Contract Total is due at walkthrough. Remaining contract total is due at completion. 10%+20+30%+30%+17% + Remaining is more than 107%! One was turned into a walk-in shower with a custom shower door. Now, they not only look amazing with high-end finishes, but they are up to code with new plumbing, new sub-floors, and custom vanities with beautiful 3 CM quartz countertops. Byron was on site and accessible at all points with one consistent crew who took great care and were great to communicate with for big and little decisions throughout the step-by-step process. They stayed in/on budget as well, and the entire process only took 13 days! After completion, we also contracted through Fresh Home Repair to recarpet 1,250 square feet throughout the entire upstairs of our home. When it comes to remodeling, I highly recommend Fresh Home Repair!"
