Just to give you an idea, our lot size is approximately 3/4 of an acre so there's a good amount of landscape. The previous home owners greatly neglected their outdoor space, so we're in need expert advice. We called Brian to set up the appointment. He showed up promptly and we took a walk around the property as I explained what our vision is. At the back of the property we have a challenge due to a major pipeline running through it. We can't plant trees or obstruct view from the air. During our walk I got a little concerned because of what I perceived to be a difficult task due to size of our lot. I didn't know whether Angie's Special would cover the time to create the design; I expressed my concern to Brian, but he reassured me that it was covered. Also, during our conversation I learned that they don't do ponds. I want to emphasize that the ponds are not the focal structures in our landscape, but rather one part of an overall goal. At the beginning of the consultation, Brian asked for one of our land surveys which was okay with me as long as it wasn't destroyed. It was folded multiple times which I think it was really unnecessary; it was used to start the design layout. From previous experience, we know that plots can be obtained on-line. The design layout was started after our walk through. I didn't really think to track time, but I would guess that it took approximately an hour from beginning to end. To make the review short, Brian was kind to print the design for us on the spot. He made a commitment to send me the image via e-mail right away so that we could have a electronic copy, but we never received it, nor did he follow up with us. That evening we sat down looking over the design, and we feel what we received was poor work. Note that we are not landscape developers or have any formal training, but we are nature enthusiasts, we have done our research and we know what we want to accomplish with our landscape. The document that Brian provided was not professionally completed. The design really has no concept in our honest opinion. And if we were to compare it to other landscapes, it would be a cookie cutter design. We feel that the time invested in creating the document was drawing in the standing objects, such as trees. We expected to receive fresh ideas to help us achieve a beautiful and exciting landscape. Instead, we received a document with lines that can't be implemented due to the aforementioned pipeline. THIS IS A CONTINUATION FROM THE BOX ABOVE. With so much money & clothing being lost & unaccounted for, I sent the owner of Uptown Couture the following letter: On June 3, 2012 I provided Uptown Couture with a minimum of 216 of my personal clothing items (many items new with tags &/or hardly worn; brands including by not limited to Alfani, Jones New York, Karen Kane, Ann Taylor Loft, Express, Coldwater Creek, International Concept (INC), Harley, Emma James, AGB, Rafella, Maurices, New York & Company, Tommy Hilfiger, Lucky, Mossimo, Limited, to just name a few). Without my knowledge & consent, you began auctioning the items on Ebay with the first sale being 16 Coldwater Creek items for a total of $21.36 on June 12, 2012. I received the inventory list on June 21, 2012 in which I immediately asked why I did not see all of the items I provided you with, specifically the higher end items. You explained to me from a business aspect it was not efficient to take the time to document everything as the quantity was such that it would take a significant amount of time to do so. In reviewing the inventory list, it appears the ?lower end? items are listed individually & the ?higher end, higher quality, bigger brand named, more expensive, & new with tags items? are grouped in the ?multiple quantities? bucket of items. I received my first reimbursement check dated June 20, 2012 indicating 9 of my items sold for a total of $99.93 with my payout being $69.95 (70% as initially agreed upon). On June 24, 2012 you auctioned 52 women?s career pants & skirts for a total of $12.62 (averaging 24cents/item). To be completely honest, with the brands & quality of clothes I provided to your store, I would expect (taking the higher end & lower end clothing in a lump sum) a consignment store would easily get on average of $15.00/item?..& that is low-balling the estimation as many of the higher end items were $80-$100.00+/item new with tags or in excellent condition. After being told July?s reimbursement check was in the mail multiple times (which has still not come), you finally reimbursed me $100.00 cash on August 10, 2012 for the ?7 items that sold between June 15 & August 10?. This statistic is not congruent with the sales inventory you provided me with. I have spent countless hours attempting to contact you to arrange times in which we could discuss, meet, & together strategize solutions that we would both find acceptable to resolve this very disheartening situation. I was hopeful this situation would have been resolved by now. Unfortunately, after reviewing the inventory & sales records, there remain 109 of the 216+ of my personal belongings in your possession, which after multiple requests, you have failed to either reimburse me for or return to me. I would like to resolve this issue as respectfully, honestly, & promptly as possible. With that in mind, I think it is only fair & honest that you reimburse me an acceptable amount of $1,350 for all 216 items within 48 hours?the math rationale being that of 216 items x $10.00/item -30% - ($169.95 already reimbursed). In the event that you can account for the 109 clothing items, I would find it acceptable that you return all of those 109 items to me (after I ensure they are truly mine) & reimburse me $580.00 within 48 hours (107 x $10.00/item -30% - the $169.95 that was previously reimbursed) for the 107 items that you have sold. As I said above, it is my goal to resolve this issue respectfully, honestly, & promptly. I have lost much more than a wardrobe of high quality clothes, money, & countless hours, but have also succumbed to countless hours of unnecessary anguish. If acceptable resolution cannot be agreed upon within 48 hours, then I have no choice but to pursue legal action & consultation with the Better Business Bureau, Hudson Police Department, IRS, Consumer Complaint Agency, Angie?s List, & the media. The project was no where near completion by Christmas and we had to change the venue for our Christmas gathering. Then they took two weeks of vacation over Christmas where they did not do any work. They submitted their final bill stating the job was complete on January 12, 2009. I inspected the job and had a minor change to request prior to finalizing final payment. Casey Construction demanded that we pay an additional $3000 to make the minor change (two other contractors estimated the change at <$500). We refused to pay more and requested that they make the change. They then showed up at my parent's home on January 29th and removed the patio doors and nailed up chip board over the doorway openings. We were told that we would get the doors back when we paid the final payment for the remodel project. We contacted the police immediately but they told the police that they removed the doors to add a lacquer coating. Since this time we have been battling in court over how much is due them. In addition, the fireplace has never worked. We were notified by the building inspector that Casey Construction did NOT pull the permit for fireplace installation and did not hire a subcontractor who was licensed and bonded to do this type of job. Now it will cost an additional $2000 to correct this error. Please do NOT make the same mistake that we made hiring Casey Construction. Also, beware!! They may change their names and work under a different name as one of the employees has done in the past.
