First of all, as far as I know, Reggie's company is not licensed to do home improvement work in the District of Columbia.
Second, he ultimately refused to do the work. On 10/4/11, I signed an agreement for Reggie to plaster the walls in my house--all 3 floors of interior walls, with a skim coat only (no lathe)) for a total of $16,000. At the same time, he was supposed to finish a section of the basement that I had hired him to do but he never finished. at no additional cost.
I paid Reggie a $2,000 deposit. At the time I signed the agreement, Reggie said he was busy through mid-November, but after that, he would be doing only small stucco "chimney jobs," so if I called him the Friday before I was ready, he could begin the following week. That suited me, because I would be ready about then, and he knew I was trying to keep work progressing on my house. The contract specified a start date of "4-6 weeks" from acceptance (I signed 10/4/11, so start date would be roughly Nov. 18).
Reggie was not ready when I called in late Nov. I called Reggie just before Thanksgiving, and he was working on some job in Goochland. To fill the gap, I rescheduled the tiler to begin his prep work. Reggie called me on 12/14/11, but since the tile guy was working and the holidays were coming up, he said it would be better to wait until after the holidays. This puts us into Jan. 2012.
On Jan. 3, 2012 (the Tues. before the week I was ready), I called Reggie to tell him I was ready, and that he should start the following week. He said something had gone wrong on a previous job, and he would not be ready for AT LEAST 2 weeks more. I asked him if there was any way he could start earlier, and he refused. I then gave him the option of starting the following week--since I was giving him 3 more days of notice than we agreed--or I would replace him if I could find someone who could start on time. He said he would not start my job without finishing [the repairs] on the other job that he messed up.
After my GC found a plasterer who told us he could start on time, I called Reggie and gave him the option to start on time or refund my $2,000 deposit. He argued a little, but then said he would refund the deposit.
On Jan. 12, 2011, the replacement plasterer said he could no longer start right away (a very large contractor he usually does work for called, and that exponentially larger job took priority). I called Reggie and offered him the opportunity to re-take my project instead of doing the refund.
Reggie never called. I sent him an e-mail, and his response was "I can't believe your audacity." That was it. No other response. It has been over 2 weeks now, and he will not answer my calls, will not return my calls, and will not respond to my e-mails. I have asked when he intends to refund my deposit, and he does not answer.
My general contractor called him, and Reggie argued with him for a while and said he was going to keep my deposit for his troubles.
I used Reggie before to plaster the lower part of my basement wall, and he seemed fine, except for the section he left unfinished. Now that he refuses to finish that and he is keeping my deposit, it seems like he's taking his financial troubles out on his now former repeat customers (he said he is paying the IRS for tax evasion and refuses to do jobs for contractors because they don't pay him).
Since Reggie and his company are not licensed in DC, he is not entitled to keep any money until he completes all of the work he agreed to do. Since he has not done any and from his behavior seems intent on not doing any, he is obligated to return my deposit (D.C. Code § 28-3905(k)) and has no legal basis to keep it at all. This principle is well-established in DC (see Truitt v. Miller, a D.C.
