We discovered that a cabinet had been removed from the home and also the shed had been cleaned out. My realtor contacted the listing agent who claimed to have no idea that the seller had removed the cabinet. Later that morning I received a call from the title company stating that the title was not in the seller's name and that the sale could not move forward. On 10/16/15 the listing agent called my realtor and told her I could just move into the property if I wanted to! I refused since I felt that was not legal to do that. I requested my deposit back. The listing agency wanted me to sign an agreement that I would not make any claims against them and they would return my deposit. I refused to sign the document. The deposit was returned to me on 10/28/15. The property was put back on the market and the listing agency is telling prospective buyers that the owner died between the time that I made my initial deposit and the date of the closing when in fact she died 6 weeks before I made my first deposit. I am now suing Keller Williams for the amount I spent for home inspection and appraisal and damages. The original listing agent, Kathy Snyder has left Keller Williams and is now at RE/Max. The new agent is Carol Griffin. Ms. Marino finally completed her work and submitted it to the VA (uploaded) on Friday of the MLK weekend. Disregarding the rule that states if an appraisal is short, the appraiser should notify the lender client to see if there are any other comps that could be used. Once I had a chance to review the appraisal, I could see that her reason for insufficient value was purely due to using inferior comps from locations on ponds, or small lakes. For example my lake location is a 532 acre lake, whereas the lakes and areas she was using were 30-50 acre lakes.
She came in $40,000 short, and would not adjust, and became belligerent towards myself and the lender. VA finally reviewed her work and found that she was incorrect, and the appraisal was corrected.
We were under contract for the property to close by 31 January. If it closed on or before 31 January, the seller was to provide a $5000 closing concession to our family. It was going to be used to pay some of our closing expenses. Since we were fighting for the appraisal to be corrected it took too long. We were unable to close on the loan until Jan. 10, 2012.
The stress MS. Marino's incompetence caused was great. I hope she gets the Karma she deserves one day!
