Initial Contract Amount: $18,800 Revised Contract Amount: $26,400 Amount Paid by Complainant: $16,800 Project Duration: April 12, 2016-June 18, 2016 (Two months, six days) Nu Home Inc. entered into a contract for interior remodeling with the complainant in the amount of $18,800 on March 24, 2016. Before work began on the complainant’s home the following scopes of work were added to the contract: painting of upstairs area, hardwood floors upstairs, bathroom demo downstairs, and tiling of downstairs bathroom. The cost for the additional scopes of work was $7,600 bringing the new total to $26,400. Work began on the complainant’s home on April 12th, 2016. Additional changes were requested by the homeowner once work on the project began. The requests were as follows: Can lights upstairs Additional can lights upstairs Can lights and switch in the kitchen (this required the removal of subfloor upstairs) Painting of the downstairs ceilings Removal of tile ceiling in downstairs bedroom Repair of existing sheetrock beneath tile Frame in and sheetrock over built-in cabinets Reframe bathroom wall to accommodate recessed vanity The changes listed above were not calculated in the revised contract amount. These changes created delays in obtaining material which resulted in difficulty completing the individual scopes. The additional labor required to complete the added scopes created scheduling delays on the complainant’s home. On Thursday, June 16, 2016 two employee’s working on the project quit without notice when their demand for an immediate increase was denied. This issue was discussed with the homeowners. They were informed that it would take a couple days to adjust and move additional employees to their project. On Saturday, June 18, 2016 the following message was received from the complainant, “We were thinking- Our job has been a struggle for you and us and we need to get it done. How about you finish the outside where the new window was installed and we’ll finish the inside, and we call it even.” Despite the fact that the $16,800 which had been paid did not cover the work performed, the agreement was accepted. On July, 28th, 2016, the complainant sent a list of expenses totaling $5,800. In the complaint it stated that these costs arose from issues unearthed after work had concluded. Most of the issues presented had been discussed prior to the agreement and were issues that the complainant was aware of prior to making the determination to finish the inside on their own. The remaining expenses received were for scopes that had neither been completed nor paid for. Because the complainant was dissatisfied with the terms previously proposed by them and agreed upon by both parties, the complainant was offered $2,200.
