"*Signed contract on 12/29/17 for removal of old deck and construction of new screened-in deck on a cabin designated for short-term rentals. *Verbal agreement for work to be done within two weeks in January 2018 so blocked off time before rentals began. *Old deck was removed and then construction of new deck was post-poned repeatedly. *On 3/2/18—a family member took pictures of work site left with unsafe piles of rubble. Pictures were sent to Mr. Webb who then proceeded to curse at my wife on the phone when she insisted that the work area be cleaned up telling her that he won’t have her complaining just because “I spent a couple bucks”. Photo Exhibits 26-28 *Inquired as to status of job on 3/9/18 and was told it would be finished 3/14/18. *Contacted by Mr. Webb on 3/19/18 indicating he wanted paid and was told to send us a bill. *Told Mr. Webb on 3/28/18 that we had decided to personally inspect job before paying because of the delays and the way we were treated. *Mr. Webb met us on 3/30/18. Showed him the construction flaws (including scratched panels covered with spray-paint; gap between posts and siding; glass all over the ground; stringer was 2 inches short; door was not hung properly causing it to stick; 6 x 6 post had 2 x 16-inch splinter; trim only had one screw holding it fast) and he made punch list. Photo Exhibits 1-14 Mr. Webb said his grandson would come pick up glass that day and he did not show. Mr. Webb also said his worker would be there Saturday to work—he showed up and looked at items but did not work that day. *Later contacted on 4/10/18 that items were taken care of. Worker sent pictures taken from a distance which appeared acceptable. Photo Exhibits 21-25 *Neighbors viewed work on 4/13/18 and informed us that panels were still scratched and expandable foam was poorly applied. Mr. Webb was contacted. *Mr. Webb called 6 times on 4/16/18 cursing and complaining that he wanted paid. Employee of our business heard the cursing during two of the three of the calls in which it occurred. *Mailed check for $8000.00 of remaining $12,000.00 balance on 4/17/18. *Received photos from neighbors on 4/18/18 showing panels and explaining some heat expansion issues. Information was forwarded to Mr. Webb. Photo Exhibits 15-20 *Between 4/19/18-4/23/18--Mr. Webb made repeated phone calls and text messages wanting neighbors to meet him there to show him the issues. We informed him we were not subjecting the neighbors to his behavior. Also, questioned several times about when check was mailed and to what address it was mailed. *Mr. Webb told us to take $500.00 off the price and finish the job ourselves in a text message on 4/22/18. We refused this offer *On 4/25/18 (a day we had a guest coming in and had told Mr. Webb not to work) His employee again replaced 3 panels and “fixed steps”. This time the right stringer is to long Photo Exhibits 29 *4/27/18 Mr. Webb called asking for final payment could not understand steps were still not right. He did not go to the location after they were worked on again. We finally gave up sent him the final payment of $4000.00 on 4/28/18."
