I'D HAD THIS COMPANY APPRAISE THE SAME PROPERTY IN FEBRUARY, 2005 AND ASKED THAT HE DO A NEW APPRAISAL. I WANTED TO USE TOWNSEND BECAUSE I'D USED HIM BEFORE AND HE IS IN TOWN WHERE MY LOAN OFFICE IS IN CALIFORNIA. WHEN THE APPRAISAL CAME BACK, THE LOANING INSTITUTION WOULD NOT ACCEPT IT BECAUSE APPARENTLY HE HAS BEEN BLACK LISTED ON SOME LIST AND THEY TELL ME HIS LICENSE IS EXPIRED AS OF JUNE 30, 2006. HIS LICENSE WAS ATTACHED TO THE APPRAISAL WHICH SAYS IT IS VALID THROUGH MAY 31, 2007. THE LENDER IS TELLING ME IT IS HIS RESPONSIBILITY TO FIND OUT WHAT IS GOING ON WITH HIS LICENSE, BUT HE HASN'T CHECKED ON IT AND GOTTEN BACK TO ME. I FINALLY SENT HIM A DEADLINE TO FIND OUT WHAT IS GOING ON WITH HIS LICENSE OR I WANTED MY MONEY BACK. HE RESPONDED SAYING I NEED TO GET A REFUND FROM THE LENDER SINCE THEY WON'T ACCEPT THE APPRAISAL.

Townsend Appraisal Services never had a contract with the member. Appraisers are typically contracted by Banks or Mortgage brokers, not borrowers. Our client in this case, is a mortgage broker, not a borrower. The Appraisal industry is heavily governed by state and federal laws and guidelines. Discussion with anyone except our client is a violation of Uniform Standards of Professional Appraisal Practices (USPAP) that we are licensed to follow. Therefore we are limited as to our response unless legally requested. However, we can say that the Indymac Bank did not have our current license, showing us expired and therefore placed us on their Exclusionary list. Upon investigation, Indymac Bank had declined the member's loan for reasons other than our status with them. Per USPAP guidelines, appraisal fee cannot be contingent upon a specific value conclusion, or the success of a laon applicant. Thomas Townsend, President
