In August 2006, William Holley gave me an invoice for more than what was agreed to. I questioned it, and he then abandoned my job. Shortly after, the dam began leaking. Repeated calls and requests for help were ignored and the dam collapsed within a few days. I had to hire another company to completely remove the dam and replace it (for over $60,000 more). We found that William Holley BURIED debris from the old house structures in the dam! He also left intact masonry foundation sections in and through the dam. Also, Holley improperly installed the main gas line, causing me to repair this to service our home. Also, he did not complete the retaining walls, and my family and I had to complete these ourselves. We also had to spend another $6,000 to correct grading issues in our back yard as well as get rid of countless rocks and building debris he left mixed into the soil and jutting out of the ground. The major thing, however, is the fact that Holley filed a fraudulent mechanic's lien for over $40,000, using a fabricated invoice to "support" his claim. He then sued US to collect. We spent over a year with the lawyers and eventually settled. We got a check for $8,000 from his insurance company and the lien was released. My lawyer estimated the legal battle could have cost upwards of $50,000 if it went to trial, so I took the settlement. I am sure this would have been an easy case to win, but Holley would have probably closed his corporation and left me with an uncollectable judgement. Also, he has no real personal assets of any value. Upon investigation, I also discovered that he is in arrears on child support and he is also currently under a felony fraud indictment in Wayne County, WV (hearing for July 2008). In summary, this business, this man, and his wife are the epitome of evil, with their only goal being to line their pockets at others expense. Hopefully, William will be in an orange jumpsuit in a few months and can then concentrate on wrangling cigarettes from his cellmates!
Description of Work: Holley Excavating (William and "Tassie" Holley) was contracted for several jobs in connection with our new home. These included excavating a pond (3/4 acres +) for fill around the home, placing and compacting the fill, rough and fininsh grading around the house site, constructing a driveway, placing water and gas lines, and constructing 3 retaining walls. They were also contracted to demolish and remove a small home and detached garage at the front of out property (These structures were located adjacent to the pond's dam site). This work was performed from July 2004 through August 2006. It should be noted that "Tassie" (real name Natasha) is the "president" of the corporation so that the corporation is "female/minority operated", but works full time at Marshall University and does none of the actual excavation work or is involved with overseeing the actions of the people working on the job. She came to my property for personal visits to William (her husband) only.
