According to the written contract, BCI Exteriors agreed to and quot;Re Slope all gutters and add new gutter hangers for backside gutter.and quot; The price of this was to be $450.
It should be noted that originally, we were given an estimate of $350 to re-slope all the gutters on our house, but after the BCI representative took a second look at the backside gutters, he said the backside gutters would need new gutter hangers as well, so for that reason, he raised the total price to $450. That $450 total was to be paid in 2 parts: a down-payment of $225, and then we were to pay $225 ten days after the completion of the work.
Okay, the agreement was pretty simple, right? BCI was to re-slope all the gutters on our house – the gutters in the front, the gutters on the side, and the gutters in the back – ALL the gutters. In addition, they were to “add new gutter hangers for the backside gutter.” And the price was $450.
Well, I agreed to the contract and wrote out the down payment check of $225, which cleared before they even did any work. A couple weeks later BCI Exteriors showed up to do the work.
Now, here is what BCI did: They re-sloped the gutters on the front of the house, and they re-sloped the gutters on the side of the house.
Here is what BCI did NOT do: They did NOT re-slope the gutters on the back of our house, and they did NOT add new gutter hangers for the backside gutter.
I was at work at the time, but they told my wife that if they took off the backside gutter, they wouldn’t be able to put it back on. So they simply did not touch the backside gutter. In other words, they did not complete ALL the work stipulated on the contract.
Here is what is most frustrating: The backside gutter is the largest gutter on our house and the one most in need of re-sloping. It is the primary reason why we were spending the money in the first place. In fact, the front and side gutters did not even need re-sloping, in my opinion; I just looked at that as a bonus. I have contacted BCI and asked them to finish the work they promised to do, but they have refused to honor the contract. But they have still sent me a bill for the second payment of $225. What’s even more frustrating is that the BCI rep noted that the backside gutter would be a challenge when he was giving us his estimate. So this was not a surprise.
BCI Exteriors has not done the work they agreed to do, and yet they want to be paid like they have. They are saying we are past due on our payment. But they are the ones that haven’t kept their word. I feel like a sucker for trusting this company.
When BCI realized that they couldn’t do what they promised in the contract, I feel they should have called me, explained the situation, and then given me a choice of whether I wanted to pay for the limited solution they could provide. Instead they presumed that what they were doing was good enough. They presumed that I would want to pay $450 to not even solve the primary problem. They presumed that they know how to spend my money better than I do. Does this sound like a company you want to work with?
"WOW! Where do I start… First of all the member NEVER called us about any issues or displeasure he had with the job we preformed. Eliot is correct; we did not re-pitch the rear gutter because; -When our sales person was out to the member's home he looked at the front and side gutters and those could be re-pitched; as he thought the rear gutter was the same type as the front. -The rear gutter is actually a high back gutter with the gutter flashing attached and goes under the roof in 1 piece and cannot be re-pitched, it also has no under lip for us to install new gutter brackets. Scott, our crew foreman, when at the job site discussed this with the member more than once in person so she could understand what was being described. Scott also apologized for not being able to pitch the rear gutter; and agreed with Heidi to do other work that wasn't on the contract, we also called Eliot and left him a message in that regard. Scott said to the member he would do this extra work needed in place of not being able to do the rear house gutter work; as he sealed miters on the garage porch and garage itself as the corners were leaking severely; by scraping out the old caulk and re-sealing with a marine grade polymer. Scott also re-attached 3 downspouts with some new downspout straps and re-fastening existing straps that were in good shape. Scott re-fastened all elbows and accessories with new hardware. Scott also cleaned the garage gutter that seemed to never have been cleaned and was full of debris. The other gutter on the garage was rusted thoroughly and Scott thought by trying to clean it; more damage may occur. We were just trying to do what we could! She was in communication and watching Scott with her young daughter the entire time; and we thought she would have mentioned the additional work we performed to him. As I mentioned earlier we called and left a message for the member in regard to the additional work proposed in trade for not being able to re-pitch the house rear gutter, but never heard back from him. We got the Ok from Heidi and thought everything was acceptable until we were blindsided by this response! Additionally there is no mention of the extra work we did in exchange for not being able to re-pitch the rear house gutter. Sincerely Confused! BCI Exteriors"
