I contacted the State of Oregon Contractors Construction Board, as well as the firm Polygon NW employs to determine warranty claims. I was told by both, that this type of claim was only covered for one year from the date the homeowner actually moves into the home. This was impossible to do in my case, due to the fact Polygon NW did not notify me until almost 18 months after I moved in to my home that the exterior siding on my home was the subject of a class action settlement. After getting the notification from Polygon NW of the exterior siding settlement, When Polygon NW markets their new homes developments they highly tout the 3X10 year warranty. It did not in my case, match up to the claims that were made to me at the point of my home purchase. I did some research on the exterior CertainTeed Weather Board fiber cement product, and determined that since as early as 2002 it was widely known in the construction industry, this siding had experienced as much higher than normal rate of failure. Why would a company with the size and stature of Polygon NW continue to use this type of product, and take 51/2 months to notify its customers they had a product on their homes that was the subject of a class action settlement ? I must also add, that after the failed siding was applied to many homes in our development, that Polygon NW changed the type of exterior siding they were installing on the more newly constructed homes in our development, but, they did not notify the owners of homes that were included in the class action settlement for 51/2 months? I have contracted with a licensed siding company and they are currently removing all the exterior CertainTeed Weather Board fiber cement lap siding on my home, and, replace it with a James Hardie exterior fiber cement lap siding product. I would not purchase another home from Polygon NW.
Description of Work: In July 2013, I purchased a new home from Polygon NW in their Edgewater on the Tualatin Development, in King City, Oregon. In January 2015, I received a notification from Polygon NW that the CertainTeed Corporations Weather Board exterior fiber cement lap siding installed on my home during its construction, was the subject of a class action settlement. The settlement was finalized in August 2014, and it took Polygon NW 51/2 months to notify the affected home owners in our development that we have failed, or, failing exterior siding on our homes. The remedy we were given by Polygon NW, was to file a claim with CertainTeed, and have their representative schedule a site inspection, to determine if my home had experienced any siding failure . I filed a claim within a week of the Polygon NW notification, with CertainTeed Corp. At the same time, I also notified Polygon NW at the same time that I felt that in addition to the siding failure, I believed that improper installation of the siding, during its original installation, was contributing to the deteriorating siding on my home. After having the warranty manager come out on two occasions to view my concerns, it became apparent that Polygon NW was waiting to find out what the CertainTeed site inspection before they would acknowledge any defective installation of the siding. It took the CertainTeed representative approximately 7 weeks (March 23, 2015), to come out to determine my claim. His determination was that the entire east side of my home had experienced 100% siding failure. At that time he agreed to compensate me the amount agreed to under the terms prescribed in the class action settlement. During that 7 week wait ( March 10, 2015 ) I contacted an licensed, independent siding inspector, to inspect the exterior siding on my home. He determined that there was a significant amount of improperly installed exterior siding on all of the sided areas of my home. After forwarding the report from the independent siding inspector, and, CertainTeed's inspector claim determination, to Polygon NW's warranty manager, Polygon NW finally scheduled an appointment with the original siding subcontractor who installed the siding on my home. On 4/9/15, Polygon NW's warranty manager was finally able to schedule an inspection along with the original siding contractor. At this point, Polygon NW's warranty manager has been to my home on 3 separate occasions to view the siding on my home, and the original siding subcontractor has been out once. At no time did either the Polygon NW warranty manager, or, the siding subcontractor, use a ladder to inspect the siding on my home, even though it is a two story home? The only inspection that was done utilizing a ladder access the upper level, was the independent inspector, I had contracted. The determination made by Polygon NW's warranty manager, and the original exterior siding contractor, was that the only defect that existed, that in spite of the fact that the siding was not installed to the CertainTeed Weather Board specifications, that was covered by the Polygon warranty, was to refasten several pieces of the metal flashing that were not fastened properly. Even though I was told by the warranty manager they were under no obligation to do so, to show their good faith Polygon NW would blind nail a select few boards that they determined to have loosened due to normal wear and tear. Polygon NW also told me, at that point, that for the amount of compensation I had received from CertainTeed for the failure of the entire east side of my home that they would be willing. remove the failed siding, replace it with another CertainTeed product, and repaint the replaced siding.
