"The issues that you initially experienced were promptly corrected once we were notified and we apologized for the inconvenience. Unfortunately, Falcon has no hand in the manufacturing process nor quality control of the equipment and products that are selected by the builders to be installed. Falcon is only contracted to design the duct work and install the selected products. Once we are notified of any issues, we come out and make a diagnosis based on the information available. On 6/24/2020 the manufacturer of your thermostat did confirm the model of your thermostat is defective. We were not made aware of this issue until 6/24. Falcon did not manufacture the thermostat that was installed; We stand behind our work from our diagnosis and repairs, but mechanical components (just like many mechanical products – cars, washing machines, etc.) can malfunction. The thermostat defect was not made aware to anyone until 6/24 when they sent out a guidance letter to vendors and homeowners who registered their equipment with them. On 6/23/2020 we came to your home for a service appointment. The issue that you brought to Falcon’s attention was not fixed because once we arrived, it was discovered that another contractor was brought in by someone other than the builder, which voided your warranty. Our wiring was undone, cut off, and wire nutted together in unorthodox ways, that lead to the other end being tied into nothing. When we asked the builder for guidance on fixing the wiring, we were told not to fix it. For residential new construction homes, Falcon is contracted by the builder during the warranty period, and we perform the work as indicated by the builder in our contract. When you were informed of the builder’s decision, we were subjected to disrespectful and verbally abusive behavior. Falcon stands by its work, but when the contracting customer (in this case, the builder) tells us not to do something, we have no choice but to comply with our contract."
