It was now time for me to call Rodney concerning the breach of contract and fraud. I called Rodney and told him that the mechanic that re inspected the car said the tie rods were two different colors which lead him to believe they were two different brands. To give Rodney an opportunity to tell the truth about what he had done, I asked if by mistake his assistant had installed the wrong inner tie rods. He said that he installed them himself. I said, ?I am sure you noticed they were two different colors?. He said, ?I do not pay attention to things like that, it did not matter what color they are?. I told him they were not Moog tie rods. I informed him that I had called the Federal Mogul Corporation, the manufacturers of Moog tie rods and they assured me that if it is gold, it is not Moog. Rodney said, ?Don?t you think of all the tie rods they paint they could have missed one?? I said no. I then gave Rodney another chance to tell the truth about what he had done by telling him about what Advance Auto said about filing a claim if a mistake had been made on their part. He told me to bring the car in the next morning, June 13, 2013, at 8:00 am and he would fix it, but that he would not charge Advance Auto as it was not their fault. He said he wanted me out of there and would refer me to someone else in the future. He said he would not meet me at 7-11, but to call him when I was on the leaving to let him know that I was on the way. I then called the Federal Mogul Corporation back and asked if there was a remote possibility when painting them that they missed one and they said they do not paint them, they dip them. They affirmed what they had said before, ?If it is gold, it is not Moog?.
At 7:35 a.m. on June 13, 2013 I called Rodney and told him I was leaving then on the way to his garage. Rodney said, ?I am not going to fix your car.? Raising his voice he repeated, ?I am not going to fix your car, did you hear what I said? I am not going to fix your car?. Do you know the problem this has caused, you calling Advance? I have been in the dumpster looking for the boxes.? He said, ?My lawyer said I do not have to fix your car?. I said okay. That was the end of the conversation. Later that morning after 9:00 am, I called the Advance Auto store located at 5329- A Williamson Road and spoke with the employee, Robert Blackshaw, who sold Rodney Graham the inner tie rods. He confirmed that the inner tie rods that he sold Rodney Graham on June 10, 2013 were the Drive Works brand. I asked if they were made in China and he said yes. I asked the cost and he said $26.98. I then heard an employee say to him ?Rodney? and then Robert asked me to hold the line a minute. I knew Rodney Graham was on the other line waiting to talk to him. Robert returned to the phone. A few minutes after I hung up from talking to Robert Blackshaw, Rodney called me. He said,? What is your address?? I asked if he was mailing me the receipt for the Moog tie rods and he said no. He said, ?You are going be served a warrant for harassing me and my customer Advance. I told him that I had just confirmed that he bought the Drive Works inner tie rods, not the Moog as he had agreed. I hung up and called the police to come to the house to file criminal charges against Rodney Graham. Officer J.K. Kaufman # 0955 arrived at the house at 10:10am. I showed him all the documentation. He said it was civil matter.
I sued Rodney Graham of Rodney?s Automotive and Towing for breach of contract and fraud. On July 8, 2013 I went to court. Rodney Graham told the judge, Fredrick King, that he wanted to plead his case. Judge King was doing the paper work for a court date, Rodney and I were at the bench and I looked at Rodney and said, ?Rodney, your dishonesty has caused me a tremendous amount of stress?. He replied, ?Good, I?m glad.? His reply shows no remorse for his dishonesty; and he is glad that his dishonesty has caused me a tremendous amount of stress. He has his 13 year old daughter, Hannah Graham as the registered agent for this LLC, which is illegal.
I came home from court and called Bratcher?s Oak Grove Shell and made an appointment to have the tie rods replaced with the Moog brand. The soonest they could replace them was July11, 2013. On July 11, 2013 I had the tie rods replaced with the Moog brand and the Steven Bratcher II noted on the invoice that he removed two Drive Works tie rods. He gave them to me, one is gold, and the other one is black. The serial numbers on each tie rod begin with DW for Drive Works. I have them as proof of breach of contract and fraud and will present them in court. I had a new front end alignment done at Firestone, the cost was $85.05. I have attached the invoices from Oak Grove Shell for $250.00 and Firestone for $85.05.
On the invoice from Rodney?s Automotive & Towing, Rodney Graham charged me $135.00, the Moog price, for the inner tie rods assuring me they were Moog, but installed the Drive Works inner tie rods, after market brand from China that cost $26.98 instead. Bratcher?s Oak Grove Shell charged me $133.32 for the Moog inner tie rods confirming the Moog price. I showed the judge the print out from Advance Auto in Salem showing the discounted price they quoted me for Moog inner tie rods of $135.00 as well as the invoice showing the Drive Works inner tie rods for $26.98. I took the drive Works inner tie rods, one black and one gold to court and showed the judge. I won the case and the judge granted me a judgment against Rodney. He suggested Rodney and I sit down outside the courtroom and work things out. I asked Rodney on the way out of the courtroom if he wanted to talk and he said no! He then attempted to shut the door in my face as he exited the courtroom.
In December I got an attorney involved to recover my money plus court cost. He subpoenaed Rodney and his 2012 tax return as well as his 2012 profit and Loss statement. Rodney. The court date was December 17, 2013. Rodney showed up with a check for the money he owed me including court cost.
