Henry issued a pre-approval letter in January 2007, for evidence of eligibility to obtain a mortgage loan. His client signed a contract on February 11, 2007, to purchase our home. At the time, Henry provided verbal assurances, as to his client's (the prospective home buyer) credit score, which subsequently was shown to be much lower and riskier, than we had been led to believe. As the news broke in March regarding the practices of the sub-prime mortgage industry, we became concerned that our prospective home buyer ultimately would not qualify for a loan, or would not be able to obtain a loan that he could afford. Henry had five weeks to obtain a suitable loan, or advise his client that he could not do so, but he waited until the day before settlement, to inform his client that he was unable to arrange for an acceptable loan. His client then was forced to default on the contract to purchase our home. Henry offered nothing but excuses to my Realtor.
