Jordan Design-Build Group

"Jordan Design-Build Group was retained to perform design services to the customers for the renovation of a hall bathroom. On the New Client Questionnaire, the customers represented that they did not want to modify any layout or floor plan of the existing bathroom that contained an existing tub/shower. Along with the New Client Questionnaire they submitted numerous inspiration images of bathroom schemes they liked but there was no specific statement about removing a tub/shower and replacing it with a stand alone custom shower. At the preliminary design meeting, the customers again did not mention that they wanted to replace the tub/shower with a custom shower. Based on the previous communications and meeting, our Architect and Interior Designer prepared design drawings, elevations and portfolio images for the bathroom including proposed floor tile designs, new tub and tile surround, vanity design, and the selection of many other materials and fixtures. These design drawings and documents were presented at a second design meeting where one of the customers apologized profusely for the miscommunication indicating for the first time that she wanted to install a custom shower rather than a tub/shower configuration. That fact had not been communicated to our firm in the prior design meeting. We immediately informed the customer that a custom shower may be more expensive to construct depending on the choice of materials and may require some modification to the existing drain lines (which were not visible and thus unknown) to comply with the building code. Jordan Design-Build Group offered to have its plumber investigate the drain size at no additional cost to the customer and was willing to continue with the design phase of the project providing designs for a custom shower. The customers did not want to continue with the project and their response was clear and direct stating that Jordan Design-Build Group should discontinue all work, that they wanted to terminate the agreement and start the whole process over again, in other words they wanted to hire someone else. Later they claimed that Jordan Design-Build Group was in breach of the contract. We strongly disagree with that position. Our company performed substantial design services and expended numerous hours working on the customer’s project through the time that the work was placed on a stop order and was always willing to design the custom shower as part of the project for the client. Jordan Design-Build did not send (nor did our attorney) the customer a bill for $220 as claimed in the customer’s post."
