It was as much of a nightmare as you can imagine. Wes Paxton failed to disclose the buildout on the second floor to the city building officials when applying for the building permit. His subcontractors also delayed getting their permits until the work done upstairs was already covered up. So no inspections were called in prior to the work being covered up. Paxton used a temp service to help install the insulation. Which did not meet code prescribed levels. The home shakes violently in the wind. it shakes even when someone walks through the house. They did not do any geotechnical study prior to installing the piling foundation. and failed to install the pilings to the proper depth. A forensic engineering firm was hired by me, and determined the piling are overloaded and over-spanned. Paxton Construction utilized unlicensed subcontractors to perform work on the home resulting in poor workmanship. The carpenter was not licensed and did not build the shed dormer properly. The plumber did not disclose the upstairs bathroom to continue the illusion that no work was performed upstairs. The plumber did not vent any of the vents through the roof and used illegal AA Vents instead. The electrician also delayed getting his permit by two weeks, until the second floor was complete and painted. Resulting in the upstairs electrical system not receiving any inspection prior to being covered by drywall. Some of Paxton's subcontractors displayed propensity to violate Virginias Building Code in order to remain in the good graces of the builder. I was told by the unlicensed carpenter that he knew he was doing wrong, but he didn't want to say anything in fear of loosing future work with Paxton and Paxton's builder buddy. He said they were close church buddies and he worked for that guy, mostly. After complaining to Paxton about the issues in the house and his refusal to fix the issues, I complained to the city building officials. it was then discovered Paxton did not have permit coverage for the second floor. The city inspectors issued approximately 9 code violations. Paxton filed a mechanics lien on the home. Not one, but two of them, which equalled over twice the unpaid balance of the contract. Paxton was represented by his son-in-law who is a new lawyer. Needless to say both mechanics liens where defeated. And the resulting complaint turned into a civil dispute. Ultimately Paxton settled the morning of court by mutual dismissal of the complaints and he paid $10,000 in addition to the dismissed $42,000 of the remaining alleged balance of the contract. I should also mention, during deposition, Paxton admitted to altering notarized lien waivers. And stated his daughter was the notary that notarized lien waivers which were notarized nearly two weeks after the principles signature. Paxton admitted to altering the suppliers lien waivers by writing the dates and dollars amounts on their lien waivers. Paxton testified during his deposition that he was allowed to sign my name on a document requiring my signature because he was acting as my agent. Paxton was never assigned the right to sign my name on anything. No agency agreement existed between us and he never had any power of attorney which would allow him to sign on my behalf.
Description of Work: Paxton Construction was to provide a turn key 4 bedroom, 3 bath modular home on pilings with front porch.
