In July 2006 I called Mr. Miller because my lawn was dying. After a week Mr. Miller had not called, so I called him again. He did not return my call. The next time I called Mr. Miller it was August and he still did not call me back. Finally on the fourth phone call, Mr. Miller talked with me. I told him about my lawn, and that I was annoyed that he had refused to call me back. Mr. Miller came out the next day and said I needed to water my lawn and it should come back. I had been watering may lawn previously, and continued to water it, but it did not come back. Mr. Miller then said that my contract had run out and he was not going to do anything. I contacted Fairfax County Consumer Affairs(FCCA). Mr. Miller told FCCA that I had to prove that I applied 12,500 gallon of water per week for 6 out of 8 weeks from June to the end of August. FCCA found that demand unreasonable and not stated anywhere in the contract. Bottom line was that Mr. Miller refused to honor the guarantee.

"I PROVIDED A WAY FOR YOU TO PROVE WHETHER YOU WATERED THE LAWN ENOUGH. I KNOW YOU DIDN'T FROM THE WAY THE LAWN DECLINED. MY CALCULATIONS ARE BASED ON FACTS ONLY. ONE GALLON OF WATER IS 231 CUBIC INCHES, WHICH WILL COVER 231 SQ.IN.(1.6 SQ. FT.) W/ 1 INCH. LAWNS NEED 2 INCHES OF WATER PER WEEK TO THRIVE. THEREFORE YOUR 10,000 SQ FT LAWN NEEDED 6250X2=12,500 GALLONS OF WATER FOR EACH WEEK IT DIDN'T RAIN LAST SUMMER. THIS IS SIMPLE MATH AND DOESN'T ACCOUNT FOR AREAS IN WHICH WATER WILL RUN OFF. IN CASE YOU DIDN'T NOTICE, IT QUIT RAINING AFTER THE FLOODS IN JUNE THROUGH AUGUST. YOU STARTED COMPLAINING ABOUT 2 WEEKS AFTER THE FLOODING OCCURRED THE END OF JUNE. MAIL ME COPIES OF YOUR WATER BILL TO PROVE ME WRONG. I DOUBT YOU CAN. ANOTHER POINT IS THAT YOU NEVER PAID THE LAST BILL SO YOUR ACCOUNT WAS DELINQUENT AS JUNE 25. WE CANNOT PROVIDE ADDITIONAL SERVICES TO NON PAYING CUSTOMERS."
