 + 3 moreThroughout this time, he left the interior trim of the windows in the living room and the master bedroom uncompleted. After my Father(a former client of J.A. Zehala)called him, he finally sent an employee on October 3, 2008 to finish the installation of the interior trim work around the windows in the living room and master bedroom. The trim was installed, but was not painted, and none of the drywall that was disturbed in the master bedroom was patched. At some point on Monday October 6, 2008, he did remove the accumulating debris from my front yard. After letting more than a week pass, I called Joe Zehala of J.A. Zehala on the morning of October 14, 2008 to see when he planned to finish the work on the windows. At that time, he told me he would try to send someone out at the end of the week. Having been told the same line several times before I told Joe Zehala of J.A. Zehala that I wanted the windows done by the end of the week or I would have to lodge a complaint and potentially take him to small claims court. He became very agitated and told me not to give him an ultimatum and to go ahead and sue him if I wanted. After pointing out that the contract stated the work was to be completed in 4 to 6 weeks he hung up on me. The next day I filed complaints with both the Virginia Department of Professional and Occupational Regulation and the Fairfax County Department of Cable Communications and Consumer Protection. I am still awaiting their rulings. I hope that anyone reading this will be saved from having to endure the experiences I went through.
Description of Work: On August 13th, 2008 I entered into a contract with J.A. Zehala, the contractor to replace the windows and roof on my house. The contract provided an estimated 4 to 6 weeks to complete with normal weather and material delays. Changes to contract will delay completion date. For over 9 weeks from the signing of the contract, I patiently accepted J.A. Zehala, Contractor s delays. He never completed the work stipulated in the contract and I was forced to hire a new contractor to finish the remainder of the work. The following are the events that transpired since entering into the contract. On August 13, 2008 I provided J.A. Zehala, Contractor with the first scheduled payment of $2,000.00 so that he could order the windows for my house. On September 4, 2008, despite having not begun work, J.A. Zehala, Contractor requested the second payment of $2,000.00, which I provided him. On September 5, 2008 at 6:30 in the morning, the Simonton windows for home were finally delivered to my house. As a result of J.A. Zehala Contractor s failure to properly coordinate the delivery time of the windows, I had to write a check for the windows in the amount of $1,194.45. Later that morning, Joe Zehala of J.A. Zehala showed up at my house to move the windows to the backyard. At that time, he wrote up an additional work authorization form for the installation of a new sliding glass door that we had previously discussed. The charge for the additional work was listed as $1,200.00 and marked paid in full to make up for my having to pay for the windows. On Thursday, September 11, 2008 J.A. Zehala sent two employees to begin installing the windows. That day, they installed the window in the kitchen, the two windows in the upstairs rear rooms of the house, and the bathroom of the master bedroom. The next day, Friday, September 12, 2008, the two employees finished installing the remaining windows into their locations. At this point, all the windows had been hung in their locations but none of the exterior brick molding had been replaced. Only a few of the windows had their interior trim properly reinstalled. The contract states that interior trim remains in place undisturbed, yet none of the interior trim looked as it did before being taken off to install the windows. After complaining to Joe Zehala of J.A. Zehala about this, he finally sent someone two weeks later, September 26, 2008, to do touch up work on the interior trim of the windows that had their trim. The work conducted September 26, 2008 failed to complete the interior retouches required and Joe Zehala of J.A. Zehala came himself the next day, September 27, 2008 to do some patchwork to drywall that had been disturbed during the window installations.
