lawn service

I'd used Wylie Lawn Care off and on for about a year, but usually only when I couldn't do the yard for some reason (out of town travel, etc.). They normally showed when they said they would, did a pretty good job except for some hurried edging and uneven spots with the mower. The service got progressively sloppier throughout the summer though, and grounds crews are reluctant to pick up anything accidentally left in the yard. A baseball and a football were destroyed and left in pieces all over the backyard, but I find that to be fairly minor. They destroyed a garden hose the next visit, but replaced it for cost, so that seemed fair. The next summer, 2011, I scheduled them to mow my yard on June 15th while I was out of town for work. They showed up two days later than they said they would, and refused to return phone calls between the 15th and 17th. I finally scheduled someone else to mow (from out of state via google and a cell phone!), and low and behold, they showed up. Not a big deal. Cancelled the other provider, Wylie Lawn Care mowed the lawn, and that was that. Then the following Wednesday (22nd), less than a week after they mowed, the crew showed up unannounced, told my wife we had a "subscription" and that they were done mowing the front yard and needed in to the back. She told them they weren't supposed to mow, that it was a one time service (we never had a regularly scheduled service), but they insisited they had talked to me, so she relented, paid them, and they finished and left. I called the service when I got home that evening, left a message on their voicemail, and the owner called me back. He apologized for the mistake, said that it was his scheduling mistake, and assured me that it would never happen again. I explained that the lawn didn't even need mowing, and asked how he wanted to make the issue right. He told me that even though I didn't authorize it, that the service was done and paid for, and there was nothing to do about it. Despite his admitted mistake, the owner accused us of trying to get "something for nothing". I explained that we just didn't want to pay for unnecessary and unwanted service. He told us that he didn't need our business, that he had over two hundred customers, and that we just would part ways. He was very nasty on the phone, despite our being fairly regular customers for a couple seasons. About an hour after he hung up, he called back and apologized for ending our conversation that way and agreed to provide a refund of the services. Since I paid by check, I told him that he could just dispose of the check, but he said he already deposited it in his account, and would have to draw up a new check and mail it out to us. He reiterated that he felt we should have just paid for the service before he hung up, and complained that his men wouldn't be paid for the job. I reminded him that it was his mistake that caused the men to not only be late the week previous, but also to come out and do a job without permission, and that it seemed unfair for his work crew to suffer. After waiting two weeks for the check to come, IT NEVER DID. I complained to the better business bureau, but he never responded to the complaint.
Description of Work: Had the company mow and edge a private residence on several different occasions. Great initial service, but very poor service by the end.
