I requested bids and accepted the one from Bazan. We signed a contract in January and I gave Pete Bazan an initial payment of $36,492.96. Bazan had done repairs for us previously and work was satisfactory. Pete said that the repairs, hot oil, and rock could be done right away but the hotmix would have to wait for warm weather and might not be completed until about the first of March. The repairs were done. The two layers of oil and rock in the rear were completed. Four large posts were set in the islands in the front for the cost of materials only. Pete Bazan had offered to do this when the contract was signed. The repairs were done. The layer of tac oil and toping rock were done. The front is not complete. The hotmix has not been done. The striping has not been done. I called Pete Bazan multiple times requesting a schedule for completion. Three times we were scheduled to complete but it did not happen. The story was that the local hotmix plant was down for maintenance. Pete Bazan called and requested additional funds. No additional funds were provided. Pete Bazan has been notified that he is in default of the contract for over 30 days. Pete Bazan signed to the return receipt on the letter I sent requesting completion or a refund for the front. He has not responded to my letters or multiple phone calls. The final payment has not been made.
Description of Work: Pete Bazan of Bazan Paving signed a contract to pave a parking lot on Zac Lentz Parkway, front and rear, with a completion date of Feb 29, 2008 for the rear and Mar 31, 2008 for the front. The rear was to be repaired and then paved with two layers of tac oil and toping rock. Some painting of posts and a wire mesh fence were included. The front was to be repaired, paved with one layer of tac oil and toping rock, 1 1/2 inch of hotmix and then striped.
