TEXANA CONSTRUCTION SERVICES INC

Mr. John Berezowski stated that he would refer a pool company to build our pool and he would supervise their work for us. He then sent the company out and they met with us, designed our pool and gave us an estimate. The pool company came out and drew out the pool, when it came time to sign the contract, John told them that they could leave and he would take care of everything. We signed the contract with Texan Construction with the understanding that Alamo Pools would be doing the construction (they are the ones we had done all the leg work with). John took our check and later that day came back and stated that Texana could not do work with Alamo, and that he was going to build our pool. Alamo was told that we had changed our minds and were not going to use their design. The pool construction took longer than the contract time period. We canceled the contract when we discovered John had not been telling us the truth, had hired some shoddy sub-contractors, and we were tired of the prolonged construction. We had made our payments as stated in the contract. We were to have landscaping and a patio cover built, but neither were going to be able to be complete by May 1st. We were told that sub-contractors were going to show, but they did not. At this time Mr. Berezowski has verbally agreed to refund us our $14,000.00, but refuses to put it in writing and refuses to pay.
