We met back in Sep 24th for our first meeting. I was very impressed with Ken and the history of the company. The offer was accepted October 14th, of last year and I believe the completion date was November 18th, 2015. I paid $4,600 on Nov 6th, 2015 and $4,691.52 on Nov 18th, 2015. Ken was out for vacation for a couple of weeks but once we reviewed the work, I told Ken I was waiting for the men to come back out to do the final touch up and finishes. The roof had tape on many of the shingle that was about 2 inches wide and 4 inch long. Also I could see impression under the roof where wood had sunk in or was bulging. I would have like to have had the opportunity to learn of the imperfection in the wood, so that I could have had the opportunity to fix it or replace the boards even if it came out of my pocket. I have had three other roofs replaced over the pass 25 years, this job had worst looking finished. After about a month one of the men finally came back to cut the tape off all of the shingle, leaving the shiny tape on my grass. I was informed that once the job was complete he would take care of the insurance part of it, and then once the payout was settled, I would receive or retain my reimbursement of $500 Angie's List discount. After 3 months had gone by I receive communication from my insurance company that Ken at Jon Wright would not return their call so that they could cut the final check. It appears Ken was waiting them out until they agree to pay for the extra vents that were added to bring my house up to code. No doubt, Ken should have kept me in the loop, so that I did not find myself in the middle of the battle which had little to do with me. The problem that really bothered me the most is when I wanted to finally settle up the final payments and reimbursements, I receive a condescending email from Ken. The fustrating tone starts like this...." Marvin - attached is my final invoice, again. " Then it only got worse. He states in he email "The math is pretty easy.."as if my math skill are sub pa, suggesting that just needs to pay him the full final check from the insurance company or talk to his boss. His entire email is listed: From:

Our Agreement clearly states that the contract price is for the full insurance proceeds/total claim. I've told you from the first time we spoke that your only out of pocket is your deductible (plus any optional upgrades). I never said you would only pay what the insurance pays you and then subtract $500 from that amount. That would mean you don't pay any of your $3,180 deductible. The math is pretty easy. Take the RCV (Replacement Cost Value) that the insurance company determines and lists on their final scope of work (see page #5). Subtract your two payments to date. This gives the outstanding balance. Subtract your $500 Angie's List discount and that is the total due. My math comes to $6,158.76 which I have outlined/explained in my previous emails. I am happy to review whatever numbers you come up with over the weekend so we can resolve this matter on Monday, March 28th. Then you can bring check to our offices on Tuesday the 29th and even discuss with our owner, Jon Wright, if you like. Feel free to call or email me with any questions in the meantime. Thank you, Ken Dunn 214-738-9052 *********** My response: This email was sent at about 2am 3/25/16 Hi Ken, I am not able to down load your final invoice, but tomorrow I will try again from my phone and/or another PC. I believe your condescending tone is unwarranted, I only wanted more time to understand the numbers. I also believe the math is pretty straight forward. You are in the business and I am not so I believe you know what I am attempting to describe. This process has been more frustrating than I have experience in the pass. I have had three roof replaced over the pass 20 years, but believe me I am not an expert. I believe you want to do the right thing and that you are not trying to complicate the matter needlessly , so therefore I am asking for your help in bridging the gap between our understanding and my expectation. To lay the foundation I want to verify that you are not charging me for any optional upgrades. I wanted only what the insurance company would cover, nothing more and nothing less. I believe we both agree and realize that I am responsible for the deductible ($3180.00). I am also responsible paying you proceed from the insurance company, which were included in two separate checks ($6111.52 and later a second check for $300.06) for a total of $6,411.58. So the deductible and the initial two checks sum up to ($6,411.58+ $3180)= $9591.58. I have paid ($,4600+$4,691.52)= $9,291.52 So $9591.58-9291.52= $300.06 that I would still normally owe you if there was not an Angie’s List $500.00 discount. The only portion that I should still owe is 300.06 from the 2nd check from Imperial. Therefore $500.00 Angie’s List credit minus 300.06 still leaves me with $199.94 off final check from Imperial. Finally, after crunching all of the numbers it appears as if the extra $243.59 that you are charging me for, is related to the $243.59 depreciation amount that the insurance company won’t release because they have “found that the drip edge and gutters had been replaced but not painted.” If my conclusion are correct, that would not speak well toward the excellence the company you sold me on. I also would have hope and expected for you to zero in on the true discrepancy rather than tell me how easy the math was. At any rate, I still need you help and professionalism to resolve this matter. Marvin Robertson 214-316-xxxx. **** To Ken's credit he did apologize in a voice mail. Which transposed and unedited Voice Mail from Ken 3/25 at about 9 AM Good morning Marvin it's Kim Dunn. I wanted to call you and apologize for acting like a book soon and my email. Alright from your emails it sounded to me like we're going to we're planning to pay your deductible. So I again apologize I should not assume that I haven't had time to look over the numbers I am actually on the road right now but I did read your email before I left this morning so just wanted to reach out and call you and I will review the numbers that you that you put together and also on that on the drip that you're actually right we we're not supposed to charge you for anything that we don't do so.... *** Final resolution : Around noon time I received a call back and Lalo who agree to cut me a check for the correct amount. I received it Monday as agreed.
