It was a very traumatic experience. I signed the contract under duress since I truly don't remember everything the day after the flood. Keep in mind that I had just lost my home, personal belongings, vehicles and had to be rescued from the rooftop. After 6 months passed and having my home pass at only 55% instead of 70%, I became suspicious of the spending of the funds. When questioned, Mr. Haynes would make up excuses and never provide me with facts or receipts. The contractor committed several violations, to include: Failure to abide by the date agreed upon for completion of the project (February 1, 2014) Failure to submit a timeline Failure to submit invoices, original receipts and bank statements reflecting materials cost and labor (schedule of values-itemized) Failure to provide a portable toilet and trash receptacle for your employees. Human urine was found in paint cans in my home. Failure to provide a safe and clean work environment Failure to secure the proper permits Failure to refund/credit funds that were not used for products and services Because of the impact the company's problems had caused my family, we made the decision to seek legal action for reimbursement of products and services not rendered as per the agreement of our contract. I requested he immediately return the $12,000 check that was endorsed to him for services listed on his invoice and $3,200 from the $5,000 check given to him for installation of granite. I have yet to receive any of the funds back. Mr. Haynes is also very untrustworthy, fails to show up on time, had animal and human urine on the premises and animal feces on the floors. He was very disrespectful and bullying when I tried to fire him. I, finally, got him to sign a notarized letter acknowledging he owed me money and that he was to refund more funds if work was not completed. I had to file a complaint with the TX Office of Attorney General and contracting board of Texas and hire an attorney. Mr. Haynes pocketed the money gained by cutting corners and not replacing the materials with like materials. Coinciding with my remodel, Mr. Haynes purchased an expensive new truck, new grill with multiple burners and sink, remodeled his home, refurnished his home, and installed a high-tech alarm system in his home. When I asked how he was able to afford to do that, he stated in writing that how he makes a profit is on no one else's business and his gain. I question whether Mr. Haynes' IRS records are accurate.
Description of Work: Provider was supposed to be the contractor responsible for rebuilding all of my home, which was flooded on 10-31-2014. This flood destroyed my home and about 900 others and killed 5 people.
