A2D CONSTRUCTION

In December, 2007 I hired Mr. Boyd Thatcher s company A2D construction for a 6 week remodeling of my kitchen. A2D repeatedly required advance funds prior to the work. To date, I have advanced more than $33,000 to A2D and its subcontractors. Unfortunately, the best estimate is that Mr. Thatcher completed less than $24,000 worth of the work. There were repeated delays where paid for supplies and/or subcontractors did not appear as scheduled. Of note, the reasons Mr. Thatcher gave were vague and kept changing over time. I began to have trouble reaching Mr. Thatcher, and he started not coming to the job site for days at a time. Eventually, I was forced to speak to the suppliers and subcontractors directly. During these conversations I was told that the firms had not been paid by A2D; or that the cost of the services was far less than represented by Mr. Thatcher. Additionally, at least two firms contacted me to say that supplies I had paid Mr. Thatcher for were being held for non-payment/bad checks by A2D. Further, I was told that monies made out to subcontractors were redirected by Mr. Thatcher to his firm. When I confronted Mr. Thatcher about this list of issues he abandoned the job. He refused to do more work unless additional monies were advanced to both him; and his subcontractors directly. He said additional direct payments were needed because his subcontractors are no longer willing to accept payment from A2D. Additionally, Mr. Thatcher without warning removed all of the equipment, tools, and supplies from the job site. Further, he did not return to the job site to work as scheduled; and did not take or return phone calls for several days. Mr. Thatcher is unwilling to return any of the extra advanced funds. Mr. Thatcher has not replied to any of the repeated written (certified letter) or phone contact attempts since March 14th. I have been forced to incur significant additional effort and expense to 1) get the kitchen in working order for my family s use; 2) involve legal counsel.
