ROOMS TO GO

Reclining sofa is a defective design, when reclined you wind up sitting in a hole on a metal rod. On 12/20/14 I purchased a dual reclining sofa SKU #15087972 from the Rooms To Go merchant. It was supposed to be delivered on 01/06/15 but wasn't delivered until 01/19/15, which was actually a day that I was not at home to inspect it and my husband just signed for it, not knowing what to look for. When I tried it out that evening, I discovered that when it is reclined there is a huge gap between the seat and the back and you end up sitting in a hole on a metal rod. I called the merchant and told them that I wanted to return the sofa as it was unusable in this condition. They then informed me that they "don't have a return policy". I then contacted my credit card company and explained to them what was going on. The credit card company contacted the merchant and we agreed that they would send a service technician to look at the problem. When the service technician looked at the sofa he told me that it was not a defect but rather that it was a "design flaw" and took pictures of the gap in the sofa and told me that the merchant would contact me after they reviewed his pictures and report. When the merchant called me they said that since it wasn't a manufacturing defect they weren't going to do anything about it. I called my credit card company again and told them what the merchant had said and they filed a dispute with the merchant and credited my account for the purchase price. A few weeks later my credit card company called me and told me that the merchant had reissued the charge. They also told me that they would be sending a letter so that I could give them detailed information about the purchase and the problem and they would then try again to get the merchant to accept the return. The merchant claims they have a no return policy printed on the receipt...this information is not verbally given to the consumer and is on the back of the receipt in such light ink that it is unreadable.
