Hugh F.
Dec 2012
Home Building
I pursued Steven Spangenberg for 5 years for contract fraud, breach of contract and for personal injuries. On August 8,2012 a judgment was entered against Steve Spangenberg, in my favor, in the U.S. Bankruptcy Court for the Western District of Texas, Austin Division (case #11-11543-CAG-7).
During Chapter 7 bankruptcy proceedings, Spangenberg voluntarily admitted that he had committed contract fraud in the remodeling of my home, within the framework of a cost plus contract. The judgment entered against Spangenberg was $119,000. This was the full amount that I was seeking in the Federal Bankruptcy Court proceedings.
In the settlement agreement, I agreed to drop other charges against Spangenberg (personal injury, breach of contract) that I had been pursuing in civil court, and to refrain from assisting two Federal Bankruptcy Trustees in further legal proceedings against Spangenberg.
In their bankruptcy depositions, the Spangenbergs (husband and wife) admitted to using this same fraudulent practice with all of their "cost plus" contract clients (since beginning business in 1999). They acknowledged that they were still using this practice in their current work.
