Gadberry Construction

It went very very poorly! The contractor refused to provide all of the appropriate receipts and documentation, as set forth in the contract, to verify the pay applications that were submitted for payment. Many discussions, phone calls and emails about this point were had with Mr. Dustin Gadberry, the owner of Gadberry Construction, and although some receipts were received the General Conditions category remain undocumented. These efforts lasted for over 8 weeks and can be verified by email. With work shut down because the subcontractors walked off the job, the owner of the project was left with no option other than to terminated the contract with Gadberry Construction. On August 1, 2014 at 10:30am, the owner of the project met with Dustin Gadberry in the lending banks conference room and offered payment of the expenses that could be verified, which totaled a little more than $191,000.00. After a 30 minute discussion, Mr. Gadberry stood up and threw down two copies of a $520,000.00 mechanics lien, that had been filed at 10:09am that very same morning. The point here is that Mr. Gadberry did not come to the meeting in good faith, he came to the meeting with the expressed intention of delivering the mechanics lien. On October 3, 2014 the above issues were settled and a release of lien and a Mutual Compromise and Settlement Agreement was signed by Mr. Gadberry. Lien releases from the other subcontractors that had worked on the project were also exchanged. However, a letter to the city of Dallas assigning the building permits to the owner of the project that Mr. Gadberry had agreed to sign as part of the settlement agreement was over looked and never transferred to the owner of the project. To date all attempts by the owner to get Mr. Gadberry to honor the terms of the agreement and deliver the letter have failed and have left the owner with no other option than to sue Mr Gadberry and Gadberry Construction, Inc.
