Encore Windows and Energy DBA Nu View Windows

According to our lawyer, Encore Windows and Doors has committed breach of contract, violation of Texas deceptive trade practices act, breach of express warranty and fraud by nondisclosure. In September, we signed a contract with Encore to make 29 custom windows and install them in our house. The contract clearly indicated "Andersen 100 series Low-E Smart Sun Glass". When the windows were delivered in November, we noticed that markings described by the Andersen website were missing. There were no NFRC labels, and all had rectangular shaped glue remains as if labels were removed. In addition, two of them had fake Andersen stickers. There were cracks on the panes, some of the seals were sticking out. The quality was horrific. When we confronted them with this information, they indicated that Andersen gives them the right to substitute any product. (They don't. That's breach of contract). Andersen rep who came to look at the windows came and told us that they were not made by their company. They also gave us a letter to this effect. Encore refused to give our deposit (50%) back and tried to put a mechanics lien for the rest of the money. Our attorney was very good. We were able to get our deposit back within three weeks, and Encore was not able to put a lien on our house. What was really appalling is that the owner of Encore thought he could get away with it.
