If you buy a property listed by Loretta Thomason, make sure you add text to the Special Provisions section of your sales contract requiring the Sellers to remove all trash and personal belongings from the property prior to closing. And then, make sure you do a walk-through prior to closing to confirm that the condition has been met. On June 18, 2018 I purchased one of Ms. Thomason’s listings at a premium over asking price only to have the Sellers leave behind more than 54 cubic yards of trash and junk personal belongings. While I had not added a written provision to the contract to cover this issue, I did make it clear through my Buyer’s agent by email and by phone calls that we wanted and expected everything to be removed. We received assurances from Ms. Thomason that this common curtesy would be honored, and just prior to closing received further assurances that Sellers had removed everything possible. After closing when I discovered that virtually nothing had been removed, I met with my agent and Ms. Thomason at the property to demand that Sellers remove everything no later than July 15. Ms. Thomason admitted to my face that the condition of the property was unacceptable and that she had understood Sellers’ responsibility to remove everything prior to closing. She promised that she would work with the Sellers and my agent to remove everything as previously agreed. After being told by the Sellers that they would not contribute to solving the problem, Ms. Thomason stopped taking calls from my agent and even from her own broker. She offered no further assistance, not even an apology. Had it not been for my agent stepping up to pay for three full Junk Buster truck loads, I would have been stuck with a substantial bill. The listing agent is responsible for professionally managing the Sellers’ actions throughout the transaction. Clearly, Ms. Thomason did not. If you choose to deal with Ms. Thomason, be very cautious! Make sure everything is in writing and verify that all conditions have been met before closing.
