Mr. Hartley did not perform the work as specified. He began the demo of our property, which took more than a week and was not completed, and did not dispose of any trash. He failed to check his work which caused a 2-day plumbing leak from our upstairs bathroom, through the ceiling, and onto the floor of our living room. He agreed to repair the damages, but did not. He picked up our new vanities and sinks, and instead of delivering them to the job site, took them and kept them. He would not provide an estimate cost for materials, and demanded payment before revising our contract to account for the changes in the specified services. He sent a fabricated bill for materials he wanted to collect money for. He and his office manager has not returned any calls or responded to any correspondence.
"We appreciate Angie's List taking the time to mediate this issue with "Customer" "Customer" is in breach of contract. We both signed the contract in April and made out the payment schedule according to "customers" direction. He never kept that agreement. As time went by we were able to get a few funds from him to keep going but never the total down payment. On the day of the dispute, which was when the balance of the down payment was promised again, "customer" wanted to rewrite the contract. He did not want to make adjustments, he wanted to rewrite it. We were willing to make adjustments as needed, but as "customer" had been informed days before that we had other commitments, and we did not have the time available to go over it that day. "customer" owed us $9500.00 more for the down payment. When asked for that he vehemently said NO! He wanted to rewrite the contract. So I shut the work down until the down payment could be fulfilled. We had a number of subs, etc. scheduled and ready to go, but with no monies to pay them, I could not stand good for them without the funding. "Customer" refused to pay the balance of the down payment. A comment "customer" made that day was: we have a contract. I replied yes, we have a contract. However, since he was not willing to pay the down payment as per contract, we shut the job down until such time as payment was received. I tried numerous times to get in touch with "customer" to go over the contract and make adjustments and to get the balance of the down payment but he refused to reply. Due to his refusal to answer my attempts to contact him, I had to cancel the other subs. We put in numerous hours preparing for and scheduling those subs, etc. "Customer" was notified of that as well The sinks are in my shop, and were stored there with "customers" knowledge and permission so that they would not get damaged or be in the way of the demolition etc. As would have been all other materials for this job. I have never refused to hand these over. He is welcome to them any time. He just needs to give me a call and I will be glad to meet whomever and hand them over. The contract amount is for labor only, as stated in the contract. The contract also states any materials purchased by us for the job are due and payable by "customer" weekly. The bill we sent is appropriate and is due. A copy of all receipts were included with the bill as per contract. Unfortunately, a leak occurred for which we took responsibility. The prep work we did was done appropriately because the leak was contained and minimal damage was done. Because we had done our job correctly, the only damage was to a small amount sheetrock, Which was to our advantage because we were tearing out sheetrock anyway. So the damage was dealt with appropriately. Customer is in breach of contract, and since he is in breach is responsible for hours worked as well as the profit that we would have made on this job. Which totals well above what he says we owe him. So according to contract and the fact that "Customer" is in breach he in fact owes us."
"My guys did mess a couple of things up that we corrected, however; these folks played the shell game with us on this and we ended up doing a whole lot of work over and above. The tile was approved by husband, then disapproved by wife. this went on the whole time. My guys were so confused because they kept changing etc. She wanted it one way, then he wanted it another etc. This is a shell game They got a lot of free work out of us to try and make these folks happy, until Finally, we had done enough. My guys speak English, we are not from ca. The floor got messed up by my guys, I had a specialist come in to fix. He recognized the address and the folks name. He would not touch it due to the reputation of this customer, wish I had known before doing this one. 15 years in business, bonded, insured, 7 years straight we have won Angies Super Service awards. Although we try and make all customers happy, unfortunately we can't."
"This is evidently a case of mistaken identity. We have no record of ever doing business with this gentleman."
Kitchen remodels are always complicated and hard. Al and his team were all very courteous, friendly, and professional.
My project was pretty large, but took longer than it should because workers were called off to other jobs many times. Also, this was not communicated well, usually after the fact when I asked where they were.
On the whole quality was pretty good in the end, although it took some re-work.
