Prior to the technician giving me his feedback he lost footing and made not only a huge crack in the ceiling coming through my hallway into the house but he also made another hole through my ceiling when he was coming down the attic stairs, broke through the flooring in the attic that accesses the air handler...technician stated that his company AirMax would pay for the repairs and I made him document the damages on the invoice and I as well documented it and we both signed. To date the damages have not been repaired though I have sent both AirMax and Choice Home Warranty (Choice stated that they are not responsible or give input to the damages caused by the technician of AirMax) the three estimates as requested (damage totaling $650.00). AirMax called me to state that they gave Choice Home Warranty the same invoice/documentation that they gave me which documented what was wrong with the air handler...that it old so they cannot get parts to just replace the control board, and that the air handler needed to be replaced. they furnished them with the same pictures they furnished to me showing the control board. AirMax further informed me that Choice Home Warranty stated that they would call me to state that they are giving me a Cash Back (their max is $1500.00) in lieu of replacing it. AirMax also stated they would send me a check for the damaged their technician made to my ceilings...which I am awaiting now.I called Choice Home Warranty after several days (100 plus degree heat in this house) of they not calling me as AirMax stated they would. They told me at that time that they were denying my claim and said that the technician had on his invoice that the damages was caused due to lack of annual maintenance on the unit. I argued that it is not true and that I too had the documentation that was sent to them and that is not what was written. I called on my other phone and verified with AirMax and they stated that was not true as well and while I was on the phone they too called Choice Home to state that they did not say that and further told them exactly what they wrote and that the maintenance was up to date on the unit...they told them it was clean and that they had sent to them the same pictures that I got showing the excellent condition of the air handler with the exception that the control board board went out due to age. then I went back to my conversation with Choice Home Warranty and they then requested for me to fax not only my maintenance records/invoices but to also fax the copy of my home inspection of when I bought the house showing that the A/C units were in fact in working good condition (the inspection as well documented that all was working properly) (I bought the house one year ago July 2011) (My maintenace records/invoices for the one year that I have owned this home total 3...one I had done as soon as the house was purchased paid by the sell, one that I paid for when I moved in to make sure that it was done correctly in July 2011 and one done June 2012 as the annual as expected). I did as requested and they still said they are denying the claim. I then wrote to Home Warranty Administrations (Mediation) for Choice Home Warranty and they called me to state that they would give me $250 as GOOD WILL on their part. The two men that I spoke to that are supposed to be from their mediation are the same two that I have spoken to in the past on this whole mess...funny that at that time these two men (Alex and John)...were passed to me to speak to stating that they were supervisors. How is it possible that they too as well are Home Warranty Administrator (Mediation).
Both Alex and John said that is all they are going to give me and claimed that AirMax invoice/documentation now stated/wrote that the reason it was damaged was due to outdated wiring of the house because it is so old...impossible and I faxed them documentation that I had the whole house rewired to code professionally (licensed) in July 2011. I also brought it up to them that now this is quite different as to what they stated cased the damage previously. I asked them to send me a copy of the invoice/documentation
I can understand this and if they did the right thing and gave $1.500.00 as their contract states is their max...I in turn would have paid the $500 to complete the replacement. Here I am now with all disconnected in my attic and they making this ridiculous Cash Back of $250.00
I have pictures of all this incomplete work and the damages to my ceiling.
