Attempting to make a claim with Old Republic National Title Insurance is impossible. Communication was difficult in that there is no personal service to work with. The State Manager would not return phone calls or emails, the attorney's office that issued the policy would not offer assistance other than to confirm the problem, and it is extremely difficult to argue one's interpretation via email on such a policy. Once the attorney in Florida made the decision to refuse our claim, there is no other process other than to hire an attorney and sue. We repeatedly asked for arbitration on the matter, which is another clause written into the contract, however, this process was also refused to us. The idea that one pays for insurance, and then cannot get a person out to the property to look at the situation and look at recorded documents, and assess the situation with the property owner, is preposterous. The policy is constructed to allow for loop holes in the wording and interpretation, thus forcing a legal action at added expense for the policy holder. Our surveyor actually had to amend his survey because he also realized the lack of access to the property. Solid, explainable, defensible documentation was provided to establish our claim. I felt we were dismissed with word smithing of loosely worded clauses in the policy, and not given any personal attention by local representatives who could more visually look at the situation at hand. In addition, the county where the property is located has also admited there exists a problem. In order to get legal access to the lot, compensation will need to be paid to adjoining property owner. This compensation should be part of the claim that was refused, and more importantly, this is the exact reason a buyer purchases title insurance in the first place.
Update: State Mananger Mr. Trapp finally responded to one of the emails and stated that the local office could not help as they do not do claims. However, our plea to have some personal attention to our claim from within the office located in the same state as the property, is once again being ignored.
