Roofing Warranty Information

John,
I have not received the warranty information that is required to be sent by you according our contract. I have inspected the roof, documented the bad work and am in the process of reporting your dishonest business practices to the appropriate agencies governing your business and web sites reviewing your work.
I am taking steps to remedy this situation through legal action.
As I stated in the email below, neither you nor your agents are allowed on my property. Any communication with me, and only me, shall be through the US mail or in response to this email addressed to this email. Any attempt to contact any member of my family will be handled as actionable harassment.

John,
Regarding our telephone discussion of October 23rd the following points were discussed:
1. You came to my home unannounced after the job was complete and before sending an invoice for payment. You asked for and collected a check for payment in full for the work you performed according to the attached contract. The request for payment was made to my wife despite the fact that you had not met, spoke to or discussed the job with her previously and all contact for this contract was with me.
2. Your workers arrived at my home to preform the work without an English speaking supervisor present. None of the workers spoke English and the supervisor who did finally arrive at the site stayed briefly did not return for hours later, stayed briefly again and did not return until the the end of the day when the job was complete.
3. I made several calls to you during the course of the day to report improper work that was being performed on the plywood deck replacement. The entire old deck was removed. When you sold me this job I questioned your crew's ability to properly replace the deck. You told me that each individual piece of the old deck would be removed, a new piece put in it's place and the entire deck would be replaced by that method thereby assuring that the deck would be properly positioned for full anchorage to the rafters. This was not done and each call I placed to you resulted in a "don't worry about it, they do it all the time" response. No English speaking supervisor was sent to the site as I requested with each call.
4. I made several calls to you to report that my concerns during the course of the entire job were not being addressed due to the absence of an English speaking supervisor and the failure of any of the workers to speak English. When I explained to you that the workers didn't speak English you responded that they could "speak English when they want to". I find it doubly insulting that you admit that you send workers who can, but will not, speak English to perform your work. I understand now that this refusal to speak English and to not provide an English speaking supervisor is to avoid answering the homeowner's question so that the job is not delayed.
5. It is evident that your inability to respond to my concerns during the course of construction was premeditated as your standard method of doing business. It is clear that the your poor workmanship is covered up by allowing the work to proceed, despite my complaints, so that any fault would be too late to remedy.
6. Lacking an English speaking supervisor on the job I told you, by phone the day of the job, that you were going to have to be the supervisor. In our discussion yesterday you characterized my calls as bothersome and "picky". Despite my calls to you no English speaking supervisor was dispatched to the site and the work continued.
7. I will provide itemized documentation of the poor workmanship conducted by your company. I do not expect any "repairs" to be made but your company. I do not trust you or your workers to posses the knowledge or integrity to make any repairs to your poor work. I do not trust you to conform to the claims you make concerning the processes or quality of your work.
8. In a text message from you yesterday I was informed that the shingles that were specified in the contract were not the shingles that were installed on the roof. You stated that there would be no additional charge for the higher quality of the shingle. If you are mentioning the that the higher quality roof will not be additionally charged in order to excuse any of the poor workmanship and misrepresented sales agreements, you are mistaken. The fact that you would even mention that there would be "no additional charge" for a shingle that you obviously mis-ordered is an testimony to your disreputable business practices.
9. You continued to contact me without sending an invoice. You lied to my wife and said that an invoice had been sent.
I expect warranty information for whatever shingle that was installed, to be sent to me at my home address, within the 10 days after payment (as of 10-23-16) as specified in the contract.
I will hold your company liable for any structural problems affected by the poor workmanship of the decking installation and any roofing material warranty claims I may file in the future as the result of your poor workmanship.
I repeat that you, your workers or any representative of your company is not to come to my home. Any correspondence is to be through email at this address or through the US mail or independent parcel delivery. Do not contact any other member of my family in any form. Failure to conform to this request will be deemed as actionable harassment and trespass with the proper authorities be notified and legal actions begun.
In your text message you stated that you are going to be "bothered" until I was happy with the work. The only way this can be accomplished is for you to refund my money and pay for the additional charge for a reputable contractor to removed and repair your inadequate work. Otherwise, I don't see what you are so worried about. You got your money. Move on and just live with the consequences of your duplicitous salesmanship and poor quality work.
