Security Gate

Description of Work: Jim Raby / Security Gate and Fence from Knoxville, TN. Jim came recommended by some family members to install a metal roof and seamless guttering after we have damage from a hail storm in 5/11. We paid Jim Raby Security Gate and Fence half ($5,000) upfront with the balance due when the job was finished, we asked for proof of insurance (Liability and workman’s comp as of 3/28/2011 TN requires ALL construction company, no matter the size to ‘have’ or work under someone’s worker’s comp insurance) and were told he had it but did not have a copy with him. He was TOLD it was a deal breaker that he HAD to provide proof of insurance; his contract stated he had 3 million in coverage. He was going to start the installing the metal roof the next week, then it was going to be the next week, then the next week. When I started to push to get our money back, he said he had to go to Austin, TX to see a brother that he had not seen in 5 years and was dying. 30 days after we did a contract with Jim his contract expired, I wrote one the stated HE would be responsible for anyone or anything that got hurt or damaged since he had STILL not given us a copy of any insurance, and in my contract it stated that if he did not sign it we wanted our money back. He refused to sign it and refused to return our money. In August 2011 we hired an Attorney to file for the return of our down payment against Jim Raby (Knoxville, TN, Knox County 5th Sessions County Docket Number 1623H with Civil Warrant issued Oct 12 2011 for Jim Raby doing business as Security Gate ). Jim refused to receive his warren for the 11/14/11 court date. Then before the court date on 12/12/11 he called and left a voice mail for our attorney on the Friday before at 5:30pm that ‘he’ had a brother that died in Temple, TX and would not be in court on Monday. Well it turns out the Jim was in fact in court on Monday and had been calling our witness and telling OUR witness NOT to come to court ( looking at having Mr. Raby charged with witness tampering for that) and told the Judge that “his” Attorney was sick and could not be in court. Four days before the next court date his Attorney call our Attorney and said Jim would ‘not’ be in court on 1/23/12 because he had a brother die in Dallas, TX. I pressed our Attorney to press his Attorney for a copy of the local newspaper obituary since Jim has had three brothers die in three different cities in Texas in the past seven months. Jim Attorney called our Attorney back and said “well, it appears the brother is not completely dead yet”. My wife and I observed Jim driving down Cedar Bluff Road two days later in his British flag wrapped Mini Cooper. On Jan 23 2012 the State of Tennessee, County of Knox 5th Session Court Judge Andrew Jackson the 6th found after less the two minutes of me being on the stand testifying about Jim Raby lying about his ability to do the job, finding that Security Gate has 3 different address with one address being the TDS telephone company and the other being a abandon warehouse. The judge found Jim Raby guilty of Tenn. Code Ann 47-18-101 intentional misrepresentation & negligent misrepresentation. We were awarded under Tennessee law triple damages ($15,000 judgment). But now we have to try to collect. The company Security Gate is NOT recorded at the Knox County Business tax office nor is it incorporated in Jim’s name. On paper Security Gate belongs to someone named Deloris Lowery. Do what you want dealing with Jim Raby, but my sister in-law who also used him for what was going to be a 4 day job, that was 2 months LATE getting started, it got started 8/11 as of 2/29/2012 it is not finished.
