Better Business Bureau's Online Complaint System. Your complaint has been assigned case # 34057774. Filed against : Johnny's Marine Sales 2511 Oscar Johnson Dr North Charleston SC 29405-6840 Complaint Description: My Crownline 34 has been in this boat repair shop since 8/31/16, with very minimal work completed. I paid in advance, now J Murray won't repair it. After the business was moved around 12/16, the motor and outdrives were taken apart. Pictures from 9/30/17 show the motors lying on wood slats in pieces. Numerous attempts have been made via phone, face to face and through mutual friends to try to determine a ready date. Numerous excuses were given (sick, weather, personnel quitting) always with the promise that the boat would be ready in XXX days. Regrettably, I agreed to pay in advance for the boat repair as it was to be a one-time, lower cost, cash arrangement, so that J Murray could afford to move his boat business to N Charleston due to state law violations regarding boat repair in proximity to high tension wires. I agreed to this and asked that he sign a contract. The contract was handwritten by Johnny Murray. Boats go in and out of the boatyard while mine remains untouched with significant deterioration due to weather as it is uncovered. I'm also very concerned if/when I do get it back, it will not be properly repaired or restored to the extent that it should be. I have not had use of my boat since August 2016 and I am still making payments on the personal loan I took out in order to pay for the repairs, in addition to the original cost. I can't begin to tell you how upsetting this is for me. I had an attorney write him a letter, which did no good. The attorney sent an email explaining the situation. My suggestion is that I write him a certified letter, advising him that he is in breach of the agreement; that if the boat is not fully repaired or full refund made within 30 days of the date of the letter, that you will file a lawsuit against him; then follow through if he fails to comply. Also, I would note that after the expiration of 30 days, if there is no compliance, that you will be removing the boat and parts from his facility and seeking repairs elsewhere, holding him responsible for both the money he has taken from you, unjustly and in breach of contract; but also for the cost of repairs that exceed his original contract amount. (i.e. he took 17,500.00 from you. If you have to spend 20k, then he will owe you an additional $2500.00 for your cost in "covering" for his failure to perform, in addition to the $17,500.00 contract amount. If you want to see his court history, go to Charlestoncounty.org;go to online services and "circuit court search." Type in the validation code and type in his name, last and first. You will see a long list of actions and judgments. Basically, you picked the wrong guy to do business with. A real bad guy. The best outcome would be for him to fix the boat and get it up and running; because quite frankly, a judgment against such a low life is not worth the paper it is written on. I hate to ask that you spend money on me, but I have to get paid for what I do. I charge $275.00 per hour for my services; and a minimum charge of $250.00 at the outset of writing the letter; because inevitably, there is some follow up discussions. I can bill you for my additional time if it goes that way; but hopefully a strongly worded letter and some communication from me will get him moving on the fix, rather than be subject to yet another monetary judgment. It may be that he agrees to hop on it and get it fixed; or if not, at least all you would be out in attorneys fees is $250.00. If we file suit, it would be hourly with a retainer of $1500.00 plus $500.00 in litigation cost money, charged out at $275.00 per hour.In my opinion, that would just be throwing good money after bad. You may spend a bunch of attorneys fee money and end up with an empty, worthless judgment. There is no perfect outcome in a situation like this. He has long ago spent that money, rest assured. I also have a copy of the contract written by Johnny Murray. I hope you can help me, I've just about given up. Tks, Leslie R Your Desired Resolution: I contacted the attorney a few months after our initial discussion, after J Murray failed to perform again. He was not inclined to get involved as he felt that a judgement would be worthless and I would be throwing good money after bad. Boats go in and out of the boatyard while mine remains unrepaired. I have the pics from 9/30/17. At that time and ever since, there has been significant deterioration, because it is not covered/protected from the weather. I am also very concerned if/when I do get it back, it will not be properly repaired or restored due to significant deterioration. Ultimately, Johnny Murray moved his business from N Charleston and took my Crownline CR 34 with him to whatever rat hole he crawled back into. The boat originally cost $200,000.
