"(member name removed) contacted us multiple times about performing work on his property. I prepared a bid which was presented, accepted, and signed by (member name removed). Our policy is half down before start, and the remainder upon completion. (member name removed) never disclosed that he had a construction loan and payments would be divided. This was no problem and I made the necessary changes to (member name removed)’s satisfaction. The first phase was the driveway, which (member name removed) added an additional 56 feet and expected it to be completed at the original bid price. We have photos that show the original drive way stakes, as well as the finished drive way. Since the payment was from a construction loan, the bank made inspections and the (member name removed) had to sign off before moving on to the next phase. The next phase was the foundation, which was done as (member name removed) wanted. He added more items to this phase and expected it to be completed at no additional charge. The foundation was completed but not as fast as (member name removed) expected. After this phase was completed, again, he signed off on the work that was completed. He decided to breach his contract by stating that he didn’t want any more work to be done on the property and that he was getting an attorney. He made the statement that his loan was not enough to cover the work that needed to be completed, even though he signed a bid accepting the terms. Our attorney was also involved and we tried to reach an agreement, but had no success.
