Pool and Spa Servicing

Horrible!
The pool liner needed to be replaced after less than 3 months of use. We
used the pool in the summer of 2007 (for less than 3 months) and JD
Pools closed the pool for us in Sept 2007. The next year we attempted to
open the pool and noticed the water level was extremely low. It was
obvious that the liner had leaked over the winter. They wanted to charge
me to replace the liner and I refused and documented my refusal in
writing. The liner had a so called "10 year warranty" and was less than 1
year old with less than 3 months of use the previous summer. After
arguing they finally agreed to install the new liner. Several months
later they sent me a bill for over $2000 for the replacement liner and
their labor. I refused to pay it and they sued me. The local magistrate
(right around the corner from their store) ruled in their favor without
even considering the facts. Typical Luzerne County corruption at its
worst. I had to hire a lawyer to appeal this ridiculous decision (favor)
that cost me $1500 in legal fees and I won the appeal. But really lost
as it took my time away from my family and cost me $1500.
The
second issue was with a request for a quote for additional concrete
around the pool. I showed the owner of JD Pools where I wanted the
additional concrete and asked how much it would cost. After repeated
requests for a written quote, which was never provided, they poured the
additional concrete while I was out of town on a business trip. They
then sent me an invoice for 3 times the amount I estimated for the
additional concrete and if I knew the cost I would not have had it
installed as it was over my budget. They never told me (verbal or in
writing) prior to installing the additional concrete how much it would
cost. The original pool contract which does not include extras clearly
stated that any additional work above the pool installation requires a
separate contract in writing. This was just that but one wasn't
provided. I refused to pay the full invoice and paid 30% which is the
amount I expected the additional concrete would cost. They sued me for
the difference and included this in the same suit for the leaky pool
liner. Again, the magistrate didn't even consider the facts (the pool
company contract states all additional work must be on a separate
contract in writing) and ruled in their favor. Again Luzerne County
corruption (friends helping friends) at its worst. I lost this in appeal
and I still don't know how as the additional concrete and the amount
was never agreed to (verbally or in writing). I am in the process of appealing.
Update 2012 - My pool liner is now wrinkling and I'm told by a pool professional it is because it was not installed properly.

I was given an estimate on 4/25/12.  I accepted the estimate, and asked to be put on the installation list.  I never got a return call.  I continued to call the office and the owner's cell phone.  Finally, I was given a date for excavation.  I was called out of work so that the excavator could outline the pool.  I was told they would be there either that day or the next.  Tuesday came and went, Wednesday came and went.  I called the office on Thursday and was told that the owner would call me back that afternoon.  No return call.  I called the owner's cell phone on Friday.  I was told "we should be able to get it this weekend.  Let me talk to the excavator and I will call you right back."  It is now Tuesday and I still have not received a return call.  I got tired of the run-around and waiting, so my nephew is doing the excavation.
Response from JD Custom Pools

"After filing for the permits the homeowner had to other work before we could start the dig. The weather plays a big part in what we can and can not do. If the weather is bad, we get backed up. It's not us that holds up the job it's mother nature. I believe a homeowner would not want us to come to there home after rains to dig, for this will cause more damage to the yard and have the homeowner very upset with us."

During the initial site (yard) inspection the owner noted that drain tile would be required between the pool and my house to divert water from reaching my house once the pool was installed. The pool was installed and the drain tile wasn't. The owner informed me AFTER the pool was almost finished that he couldn't install the drain tile because the drainage area was higher than my yard. I questioned what would happen to the rain water run off now that the pool with a slope toward my house. He reassured me that it would be okay as he graded the yard. Two weeks later we had our first summer rainstorm and water rushed into my attached garage. There was 2 feet against my house (see photo). I was pushing the water away from my house with a snow shovel. I immediately contacted JD Pools and the owner told me to dig a ditch myself and that would catch the water. Reluctantly I did dig the ditch and it helped somewhat as now when it rained I only had 10 inches of water against my house. The garage floor began to crack and eventually sink due to the water running under my garage foundation. I contacted the company again as my "ditch" wasn't doing the job. The owner informed me and I quote, "I could install the drain tile in late September or early October 2007, after the pool installation season was over. So my response was it the yard now higher than the drainage area? As that was the reason given to me in June when I was told the drain tile could not be installed. The owner then told me I would have to remove 3 sections of my newly installed fence so he could get the backhoe in to dig the ditch for the drain tile. I refused and sought out another reputable contractor to do the job. A different contractor installed the drain tile and ever since I do not get any water in my garage. However the damage was done as my garage floor needs to be replaced. I requested additional concrete around the pool and asked for a price. I asked for the cost three times however they said they'd get back to me. I wanted to know how much the additional concrete would cost to know if it was within my budget. JD Pools installed the additional concrete while I was out of town on a business, then sent me an invoice 3 weeks after the concrete was installed for an amount 3 times what I budgeted for. At the end of the first pool season (June - early Sept) JD Pools closed my pool as part of the original contract. Immediately I noticed the safety cover was not tight and was sagging. It began to gather water (2 ft) to the point where it wasn't safe for small children. I contacted JD Pools 6 times from Sept - May regarding the safety cover issue and they did not respond. I noticed the cover kept sagging more over the winter. It appeared as if the pool was losing water. When I attempted to open the pool myself in May 2008 I had to drain the water off the cover (water made it tight). The pool lost 20 in of water over the winter. They refused to replace the liner and cover.
Response from JD Custom Pools

"This is Anna owner of JD Custom Pools. In response to Mr. F review on Angie's List is totally inaccurate. We had 2 court hearings and Mr. F lost both. If anyone would like to see the papers as proof just give me a call and I will be more than happy to show and prove this report is false. Leak-liner was shipped to manufacture and found no defects or holes in liner to cause leak. I do have a letter from them stating this fact. Why did it leak? There was a small puddle of water on the cover so Mr. F had put a siphon pump on it. While draining the cover water was also coming from the pool. Plus, when he hooked the filter system up he didn't completely do it. He didn't hook that part up in the heater and the heater was leaking water from the pool. Water near garage. After completion of pool yard was grated low to driveway for water to flow. Mr. F had a load of topsoil dumped in the yard, he used whatever he needed than spread the rest where it was so this blocked the flow of water. When we do drain tile it is for the pool area not the yard. Mr. F was told if he wanted us to put another drain tile in for him it would have to be after the season is over so we can continue our pool construction business that we are in not landscaping. Safety cover- Mr. F had contacted the manufacture of the cover and did some complaining to them. A representative had come out to take a look at the cover and only thing they found was clearly clogged due to pollen from trees. Have letter from manufacture to prove. So the manufacture had taken the cover and put drain panels in at no charge to Mr. F. They would usually charge for this. Concrete-Verbal cost given to Mrs. F then she had given us a verbal ok to do the work. Mr. F just can't face the facts, problems that he had, he had caused himself not JD Custom Pools. Again, any one who would like information about this review, I encourage you to contact me. I will be more than happy to provide references of homeowners. If we are as bad as Mr. F says, we wouldn't be in business for 10 years now. When we do business, we give homeowners our cell phone numbers so we can be reach any time if they should have questions or concerns. The only time Mr. F called us was to complain. When he had called, he never used the cell phone numbers given. I would sent someone one to find out what the problem was and determined it was nothing we had done. This review will be given to my lawyer. Mr. F will have to face the facts and take responsibility for this is an inaccurate review. When Mr. F clicked the true and accurate information in this review it was totally FALSE."
