Contract language was very vague, which became problematic as work progressed. Workmanship was good, but accountability for "extras" was minimal to non-existent. Niklaus "walked" off the job before interior work was completed, claiming non-payment of extras that he refused to submit documentation for. He left job site while owners were out of country, leaving house open, w/o notice to police. He removed approximately $1,000 of uninstalled plumbing supplies from premises, which he later returned after police report was filed. Niklaus is holding 2 condenser units and humidifier, paid for; uninstalled at time of "walk." He attempted to claim as "extras" projects that had never been approved by owners as billable extras, or "extras" that were clearly included as part of the contract - i.e. delivery of tile, installation of cabinets, kitchen sinks and faucets.

"The members were a unhappy customer that wanted everything their way and was not willing to pay for upgrades that they requested. It went to a trial by jury 2 years later and was settled on February 3, 2010. The members sued Niklaus Construction for breach of contract and the jury found in favor of Niklaus Construction on every point and awarded Niklaus Construction close to $25,000. The police report was their way of discrediting Niklaus Construction. The members wanted a $375,000 addition at the cost of $250,0000."
