GM Excavating

The job was $2,600. He asked for $1,600 up front. I had to call every 2 weeks to get a status. I kept asking him to keep me informed, which he did not. He finally said he was coming on a Monday at 8:00AM. He finally called about noon and his Dad, whom I had never met showed up, complaining the whole time. He did about 60% of the work, but ran out of gravel and daylight and diesel fuel. The Dad told me that basically we were too small a job and not enough money for them to make another trip.. He told me that he did not know when they would be back. I emailed Gregg Marks, the owner several times for an update. After 2 weeks I gave him on more week to do something. He called me on the last day with some flimsy excuses. I told him the contract was void, and that I thought he owed me $600 back. He never replied. My wife, son and I had to finish digging the ditches and buy bags of gravel to complete the drains. The contract was also supposed to include seeding the yard with grass. I will now have to pay approximately $1,300 to have the yard finished. .
