The roof Eiseman installed was inspected by Blue Bell Consulting, a A.S.H.I. certified inspector. The report from Blue Bell details how Eiseman did not ventilate the roof. I also have another report from a different inspector that says Eiseman did not ventilate the roof.
The GAF Golden Pledge Warranty that I received states that the warranty does not apply to inadequate attic ventilation. Therefore, the GAF warranty is not enforceable.
Blue Bell also performed a mold test on the black material that formed inside the attic on the plywood installed by Eiseman. The mold report issued by Blue Bell states that this material is mold. Mold would not be growing in the attic if there was ventilation. That is the purpose of the ventilation.
Eiseman has refused to honor their 5 year installation warranty. I filed a claim in Small Claims Court. Eiseman did not respond to the claim so a judgement was issued in my favor. Eiseman appealed the judgement and the case was automatically moved up to the Court of Common Pleas.
I consulted an attorney and determined that the cost to adjudicate in the Court of Common Pleas was cost prohibited and the matter was not pursued.
"1. Mr. [member name removed] alleges that the attic is not properly ventilated and, therefore, his GAF warranty is not enforceable. Upon Mr. [member name removed] request, GAF prepared a report. This report stated, "that the new plywood, as well as the original decking, has been cut to properly ventilate the attic via the DCI vent system". This report was prepared after Mr. [member name removed] expressed concerns about the ventilation and the status of his warranty. 2. Mr. [member name removed] alleges that Eiseman Construction Co., Inc. has refused to honor their five year installation warranty. This statement is misleading and inaccurate. Eiseman Construction filed a first action against Mr. [member name removed] as a result of his failure to pay the balance due under the contract. Mr. [member name removed] filed a counter claim alleging damage to his property including complaints about his gutters, lost wages, and the re-installation of smart vents. On the date scheduled for the hearing in small claims court, the parties entered into a Release and Settlement Agreement whereby Eiseman agreed to repair components not related to the roof installation including caulking around eves and rakes to close gaps on the building and to provide the GAF warranty, once Mr. [member name removed] paid his balance. GAF will not issue a warranty until the Contractor has been paid in full. Following completion of the repairs pursuant to the Settlement Agreement, Mr. [member name removed] failed and refused to make the payment required to cause the issuance of the GAF warranty. Eiseman was thereby forced to bring a separate action to enforce the Settlement Agreement between the parties. That action resulted in judgment in favor of Eiseman for the amount due under the agreement as well as attorney's fees and other damages. At that time, Mr. [member name removed]had a full and fair opportunity to have his entire case heard concerning the allegations about mold, lack of ventilation, and improper installation of the roof. Those allegations and claims were roundly rejected by the court and judgment was entered in favor of Eiseman on [member name removed] counterclaim. Undeterred, Mr. [member name removed] brought yet another action alleging the same causes of action including the allegations of improper ventilation. Since the matter had already been ruled upon the court, Eiseman chose not to incur additional counsel fees and refused to appear at a redundant hearing. Judgment was entered in Mr. [member name removed] favor and the matter was appealed, as is Eiseman's right under PA law, to the Court of Common Pleas. Mr. [member name removed] chose not to file a Complaint and pursue his claim and further. As such, the state of the record in this matter is that following a full and fair opportunity to be heard on all of his issues, Mr. [member name removed] has failed to convince a trier of fact that the roof has been installed incorrectly or that inadequate ventilation exists. He also has a valid warranty from GAF which guarantees he work."
When the job was finished, they went around the whole property and cleaned up the nails and everything. It was one guy and his helper that did the siding, and they were excellent.
One of the employees from the company called and asked how everything went. I even wrote a letter to them to say how great they were. I will use them again in the future and would recommend them to everybody.
"FIRST, WE WERE NOT HIRED DIRECTLY BY THE MEMBER. WE WERE HIRED BY HER ASSOCATION. THIS WAS A ROOF REPLACEMENT PROJECT FOR (9) BUILDINGS IN HER DEVELOPMENT. PRIOR TO OUR STARTING THE WORK MEMBERS OF THE ASSOCIATION HAD TRIED TO STOP THE ASSOCIATION FROM HAVING THE ROOF WORK DONE DUE TO THE ASSESSMENT THEY WOULD BE CHARGED. BASED ON THE CRITICISM OF THE MEMBER, WE ARE ASSUMING SHE WAS ONE OF THE HOMEOWNERS WHO TRIED TO STOP THE ROOF WORK FROM BEING DONE. NO COMPLAINTS HAVE EVER BEEN FILED AGAINST EISEMAN CONSTRUCTION BY THE MEMBER'S HOMEOWNERS' ASSOCIATION. TO OUR RECOLLECTION ,SHE CONTACTED US AS THE PROJECT WAS GOING ON REGARDING HER CONCERNS. WE CONTACTED THE MEMBER ON SEVERAL OCCASSIONS TO SCHEDULE AN APPOINTMENT TO MEET WITH HER AND EACH TIME SHE WAS EITHER NOT THERE OR NOT AVAILABLE. EISEMAN CONSTRUCTION HAS PRIDED ITSELF WITH OVER 40 YEARS OF EXCEPTIONAL SERVICE. WE HAVE SUCCESSFULLY COMPLETED FULL ROOFING AND SIDING OPERATIONS IN OVER 50 HOMEOWNER ASSOCIATION COMMUNITIES AS WELL AS A THRIVING HOME REMODELING BUSINESS AND HAVE SATISFACTORILY ANSWERED ALL INQUIRIES MADE BY THE MEMBER TO THE BETTER BUSINESS BUREAU. WE REQUESTED INVOICES AND PICTURES OF TIRE DAMAGE AND THEY WERE NEVER FORWARDED."
