UPDATE: Shortly after the judgment was made Neil Fishel owner of NF H.E.A.T. gave my mother $600. After a period of time without Fishel paying any additional money, my mother's attorney notified him that he would be filing a suit with the York county Court of Common Pleas for the additional amount that he still owed. At that time, Fishel's attorney asked if Fishel could settle for an additional $400. At first, neither my brother, nor I, wanted to accept the offer on behalf of our mother. (My brother is her POA), but then, we looked at the time, money and hassle that this lawsuit would entail and decided to accept a total of $1000 and move on, knowing that this would be fully reviewed on Angie's List and that it would probably cost him a lot more than 617.30 in lost revenue because of what we said here.
BEWARE, THE OWNER OF THIS BUSINESS TRIED TO DEFRAUD MY 89-YEAR-OLD MOTHER!!
On October 17, 2014 my brother contacted Neil Fishel, owner of nf H.E.A.T. in East Berlin, PA to put insulation under my 89-year-old mother?s mobile home. Because my mother has quite a few outside cats, my brother requested that Mr. Fishel screen the insulation up in a way that would prevent the cats from tearing it back down. He agreed to do so and said he would like to wait until it the weather cooled down a little before he did it. In November, my brother called him again and he said he would do it the following Saturday, which was November 10th. My brother lives next door to my mother and he was at work the day that this job was supposed to have taken place. When he did arrive home, around 3:20 pm, Fishel was no longer there. My brother called him to see if he had done the work. Fishel told him that he had done it all and when my brother asked how much he owed him, Fishel said $1463 which was the approximate price they had agreed upon initially. My brother (Mike) told him that he would send him a check?which he mailed the same day. Because Mike had an injured knee, he did not climb under the mobile home to make sure the work was properly done.
In February, Mike had someone come to thaw pipes at my mother?s home and he was told that all the insulation was on the ground. Mike said he couldn?t understand that because it was screened up. The man responded that there was no screening at all. At this point, Mike managed to crawl underneath the mobile to take a look for himself. He was astonished to see that not only was there no screening, but a large part of the trailer was not even insulated. In addition, the insulation that he had used was only about a half-inch thick. Upon further investigation into what type of insulation should have been used, Mike was told R-19 (which is 6 inches thick) or better. Fishel used R-8 which is used to insulate indoor heating vents, which makes sense, since he?s in the heating business.
When my brother called Fishel about this, Fishel did not deny that he had not done the work. When Mike inquired about what he was going to do about it (either do the job correctly or refund the money), Fishel said he would get back to him. Needless to say, he never called Mike back. After several weeks my brother contacted him again and he said to Fishel, ?Are you going to fix this or are you going to refund the money? Fishel responded by saying ?I?m doing neither.? ?Do what you have to do?.
So, my brother did what he had to do, he filed a civil complaint against Fishel?s business, at District Justice, Richard Thomas?s office, in Dillsburg, PA. The hearing was held on May 14th, 2015. On the 15th of May, Judge Thomas found for my brother (the plaintiff) who acted on behalf of my mother. He ordered that Fishel must pay back the $1463 plus all fees and costs. Final judgement was for $1617.30.
I urge you not to use this man for any type of work. He is obviously dishonest and has no conscience. I think he proved that by trying to swindle an 89-year-old woman
