"[Member Name Removed]: Mr. [Member Name Removed], We take very seriously the care and preservation of our clients properties and their neighbor's properties. That being said, property damage does happen from time to time. That is the case with all tree care companies; no exceptions. However, when an unfortunate incident does happen we are very quick to repair the damage and reconcile the complaint. We never duck phone calls and we never deny damage caused by our crews. We did have a crew working next door to you yesterday at the property that shares the lower portion of the driveway. The Crew Leader called me prior to entering the driveway and expressed his concern about your half being freshly sealcoated. We concluded that there was ample room to enter and exit on the neighbor's half of the property and still maintain a safe distance from your sealcoated half. We took extreme care, using an employee as a spotter, not to go near your driveway. You called our office at 3:30pm yesterday indicating that we drove over your sealcoating. I returned your call at 5:30pm and was at your house at 6:00pm. Before I knocked on the door I walked the entire length of your driveway and could see no evidence of any damage, not a single track of any kind on your fresh sealcoating. I met you at your door and you walked me over to an area approximately 3 feet wide and 5 feet long that was obviously thicker than the rest of the sealcoating. You said that the tire ran through the edge of this large area creating bubbles. When I looked at it with you there was no evidence that any vehicle ran through the area you pointed out. The neighbor's half of the driveway is 12.5 feet wide. Our truck is 8.5 feet wide. That is more than ample room for our truck to safely negotiate in and out of the neighbor's half of the driveway without crossing onto your side. Furthermore, the area that you pointed out was much further down the driveway than where the apex of the turn radius would have been as we left the upper portion of the neighbor's property. The shared portion of the driveway is perfectly straight. No turns are needed from where the two join at the top to where the bottom meets the road. I am sorry that our meeting was so short and we didn't discuss this further in person. You left very abruptly after I mentioned that I felt there was no way we would have driven on that part of the driveway. Any vehicle would have left a very identifiable track. I came with pictures of the tread pattern of our truck tire so you and I could compare them. Unfortunately, we were not able to do that as there were no tire marks on the driveway. The area you referred me to is a large area, approximately 3 feet by 5 feet, where the sealcoating material was applied a little thicker than the rest of the driveway. An 8 inch wide tire traveling through it would have made a very noticeable track. Material would have stuck to the tire and would have left noticeable sealcoat marks in spots further down your neighbor's side as the tire rotated down the driveway. There was nothing like that present. Perhaps any bubbling you say you saw was due to the extreme heat that day and the material being thick.
