"In response to the complaint, I talked over several options with the owner for the project. I visited the site and she was at my office a few times. I wrote a Proposal to list each item that was to be done. Prior to signing the proposal in my office, I sat with her and read the proposal and explained each item to her. The proposal starts out saying “This is not a completed job, but a list of work to be completed at this time only”. She was aware that we were not completing the work, for this proposal. It was designed to open the house up, so that she was able to see how it would look and make a decision as to the next stage of work. We had agreed to visit that with a second proposal after stage 1 was complete. The last sentence in the proposal said that we were willing to do some additional finish work like taping of the sheetrock, hardwood flooring and trim on a time and material basis. I drew a sketch of the house to show the walls to be removed and the location of the new beam and stair placement. As I am not a NYS Electrician, I gave her a list of 4 electricians that she could call to do her work. The proposal was explicit, we were not doing electrical, plumbing, sheetrock, insulation, railings, flooring or trim in this proposal. When the front door was delivered, one of the double doors was damaged. I replaced the damaged door with a new door. The stairs were installed from the main floor to the attic. We left room for hardwood flooring (to match her new flooring) at the first landing. Railings and flooring was NOT included in this proposal. Proposal reads “include subfloor. No hardwood at this time.” She had lost her copy of the Proposal. Angie’s List had called me to ask me to send her one. I scanned my copy and emailed it to her. She had stated that she was not satisfied but did not have a proposal to go over to it item by item. My son offered her his copy. She said that she was going to have the building inspector inspect the work and would send out a check to us as long as it passed. I did not get a call from the inspector with any items to be corrected (that is normal protocol). We followed the inspector’s instructions on the stairs installation. We completed the proposal as agreed and still have not been paid."
