We signed an agreement and paid a fee totaling $3200. We made it very clear from the start, both by email and verbally, that all of the items purchased for the project needed to be returnable.
Unfortunately, several of the items purchased for our suite did not work. We were able to return some of them. We paid a restocking fee for these items.
One of the items, a couch, had a chipped leg upon delivery. We were not allowed to return it.
Other items were not returnable despite our explicit instructions. We later learned that some of these items were actually custom ordered and could never have been returned.
We sold items we could not return on Craigslist. We incurred a substantial loss on these items, as we were forced to sell them for far less than we were charged.
In addition, Coco Design applied amounts paid to Coco Design (for services (moving and installation) rendered by Coco Design and products purchased through Coco Design) to charges claimed by a separate vendor. Those charges should have been billed directly to our firm which we would have disputed as they were excessive.
We terminated the arrangement before the work was complete. We brought in others to finish the project.
Coco Design refused to provide invoices and receipts until we entered mediation. It also refused to refund the funds associated with the items that were actually returned.
We filed a claim in Washington County Court. During the hearing in January 2014 the company's owner, Lora Coburn, made claims that were not true. She was under oath.
Because we signed Coco Design's agreement which outlined a very narrow return policy, we were not able to recover any of our losses on the furniture that was never returned. The judge also denied our claim related to the moving and installation charges.
The judge did grant our claim for the funds that were associated with items actually returned. We have not yet received those funds.
