Our issue is with the concrete shower floor installed by Anthony. A couple of days after the floor was installed, a significant crack developed across the entire width of the floor. Anthony saw this when he returned to seal the floor the next day. At that time he stated that cracking was something that could happen to a concrete floor and that he should have mentioned that to us before starting the job. Anthony stated he would redo the floor, but it was agreed that we would first see if we could repair the crack on our own. We waited 1 month before attempting repairs to be sure that the deck mud (concrete) used for the floor was completely cured.
None of the several approaches and repair products we used to fix the crack produced an acceptable result. Consequently we decided that we would need to have the shower floor covered with tile. We contacted Anthony in mid-October to tell him of this decision and told him that we would be willing to supply the tile if he would provide the labor and grout for the repair.
When we didn't hear back from Anthony, we sent him a text message on 11/2 asking when he would be able to schedule the work. He replied: "I sent email to you for labor cost and date I'll check on that". When Anthony did not get back to us, we sent him 2 additional text messages (on 11/5 and 11/7) asking for his availability to complete the work.
Because we were not getting a response, on 11/8 we contacted Anthony's helper for the original concrete floor install. He said that Anthony told him that he had sent us a bid for the job. When we told him we had not received a bid, he distanced himself from Anthony, stating that he was just there helping Anthony and that his business was separate from Anthony's.
On 11/14 we received the following text message from Anthony: "I'm trying to find someone to come set and grout your tile not having any luck I'm not gonna be able to till mid to end of march".
Waiting another 4 months to have a working shower was not acceptable to us, so we hired a local person to lay and grout the tile we purchased. On Jan 11, 2014, we emailed Anthony requesting a refund of the additional cost to us ($466.95) to install tile over the cracked shower floor. Our email included the invoice for this work. Our requested refund did not include the cost of the tile that we had to buy.
On 1/12, Anthony stated in an email" "Got your email not sure about refund I was gonna charge $500 to set tile so looks like you save a little bit money." Maybe he was trying to be humorous, but having to spend an additional $900.00 (labor + tile) to fix his defective shower floor was not humorous to us.
On 1/16 and again on 2/13, we emailed Anthony saying that we believe our requested refund was appropriate because the almost %6, 000 we paid him did not result in a working shower. There has been no further response from Anthony.
