Daniel can not keep a timeline. I paid a deposit on 2/8/2020 with a verbal agreement to be completed with 6 to 8 weeks. He finished 8/22/2020. Numerous excuses were given. Even told me he had to go to Arkansas to pick up the materials (wood and metal). His supplier is actually in Stillwell, OK. Do a thorough check on OSCN and other places.

Terrible. Workers covered up multiple areas of substandard work. Workers then lied about what they did. Owner made sure work was done properly, while I spent all day watching them do it right. Chimney leaked after work was accomplished. 2 months, and numerous calls, and they still have not come out to fix the leak. I found pieces of my flashing laying in my gutter. I needed to hire another company to fix their mistakes.

The new construction aspect of the job went fairly well though we did not meet the goal of moving into the new addition by Thanksgiving 2011. We moved in the middle of December at which time the remodeling of the "old" house was to begin.               During the month of January 2012, it was apparent that things were different; work was not being performed on a daily basic; the remodeling was getting sloppy (not filling in nail holes in trim boards, sheet rock seams slowing through after sheet rock installation and painting)                When confronted with this, Daniel Avery was upset because I had filled in some nail holes; I was being too picky about the sheet rock and I had "unauthorized the pouring of an additional concrete" and that I was "trying to take over the job"  The extra concrete was for a basketball pad for the kids to play on. I had mention the possibility of it to Daniel previously. The quote per square foot was the same a what the concrete man gave me so I had the concrete crew do it. Daniel was hacked because he did not get his share. At that time, Daniel Avery told me not to talk to "my men"; the subcontractors; and he would have everything done in two weeks!               Well, it is now June 2012, a Daniel Avery has abandoned his post!               The new flooring he put down is buckled; the master bathroom looks like a cave! ( No toilet,vanity,tub,shower,tile,walls,door, did I mention you can see the inside of the attic of the garage from the bathroom!) ; two other bathrooms are unusable; no guttering; three front windows not replaced; front porch siding not complete; countertops not installed; sinks not installed; bench seating in breakfast area not complete; pantry storage not done; one new window cracked; door to garage not replaced.                Avery has acused me of being "hostile" because my attitude changed (Hello !) ; because I told him to his face that he CANNOT be trusted!

On day before concrete was to be poured, I inspected rebar and found it to be 3/8” instead of ½” per original commitment. I called Daniel. He said it was a surprise to him & wanted to know if he could double up in “certain areas” rather than replacing.  I informed him I wanted it replaced with ½”.   Again I reiterated there were still areas that were less than 6”.  I incorrectly assumed that his crew would verify that a minimum of 6” would be maintained over the entire slab before replacing the rebar – they did not, and concrete was poured.  

5/31/11 I signed contract & gave 1st payment (1/2 of total owed) for a pole barn & privacy fence to be completed.   

6/23/11 As I agreed, I paid another ¼ of payment due (as we agreed to do once the framing was done). At this time, Daniel said the entire project (including the fence) would be completed in 2 weeks.  

7/1/11 met with Daniel to address specific concerns about the work being done. At that time I gave him a list of expectations for the remainder of the build. He acknowledged my list and took a copy of those expectations.  I was informed it would be another 2 weeks before project would be completed. I instructed Daniel to NOT start on the fence until the pole barn was completely finished.  

7/12/11 I called Daniel to discuss that my expectations were not being met for completing the pole barn. After said call, Daniel & his crew came out, picked up trash & most of their equipment. Daniel took pictures of the work site & pole barn. Later that night, I called Daniel to inquire how we were going to proceed. Daniel said all is at a stop, until he talked to his attorney.  

7/13/11 Daniel came to my house with a couple of handwritten forms (a change order for pole barn & another one for the driveway into pole barn).  Both of us signed off on the change order for pole barn completion (but not for the driveway). We also both signed off on a form I prepared (my original form for expectations of completion of pole barn, including a preliminary punch list). Daniel’s change order stated that if I would not sign off on it, he would not complete the pole barn. I did sign off on the pole barn change order and agreed that he was not going to be constructing my fence.  

7/29/11 Daniel called & asked for final payment. I reminded him that punch list had not been completed and the city inspection had not been performed. Daniel said he was told by city that a final inspection would not be required. I informed him the city told me one would be required. Daniel informed me if I did not give him the final payment of $525, that he would not pay his subcontractors & would instruct them to file liens on our house. I called the city a 2nd time & was again informed that a final inspection WAS required and that Daniel was not told otherwise. On the copy of the building permit application Daniel gave me with my contract, it clearly states “FINAL INSPECTION MUST BE DONE BEFORE OCCUPANCY OR UTILITY TRANSFER”.  I had to arrange for the city to come inspect & sign off on my pole barn. Sooner Construction should have handled that.  

Later in the day, Daniel came to the house to allegedly do the punch list. After a heated debate, I informed him of the remaining items I could do without & those he still needed to do in order to get the final payment. He said the soonest he could come back out would be 8/4 or 8/5 to finish the items that needed to be finished.   

8/4 I called Daniel to inquire when he was coming to finish the work, and receive his final payment. He stated he would be by on 8/6. He never came by. I called him 3 times that day & he never returned my calls. I called him again on 8/7 to inform him I myself had finished the work that still needed to be done & wanted to know if I could deliver the final payment to him. I met him to give him his final payment. I was supposed to receive a warranty book on the pole barn, too, which Daniel has refused to give to me.  

8/9 I received a call from the electrician Daniel hired to do the electrical on the pole barn. He said Daniel had not paid him & wasn’t returning his calls. I spoke to Daniel about this. He confirmed all subcontractors had been paid, except for the electrician, but that he would be paying him.  

8/11 we had a significant rain storm, and the pole barn appears to leak in some places. I called Daniel to report it. He said he’d come out on 8/12 to have a look. He never came out.  

A little more than two months after start date, the pole barn is complete. More importantly, very few of the original commitments were met and many promises were broken.   There was a continuing battle to have his crew clean up each day, including the final cleanup of nails & screws which I did myself. In Daniel’s words the area was a “construction site”.  In the end I have a pole barn that cost more, with substantially equivalent (or less) quality than our other bidders. I am not convinced the barn will withstand our winds.  We also had nails and screws in our yard, which I had to buy a magnet to pick up all the debris. I would not recommend Daniel or Sooner Construction & Restoration for any job.

Daniel and his company did a fantastic job. They were very professional, trust-worthy, and reliable. They had a front door key and worked during the day while we were at work. If something came up, Daniel was quick to call us and was ready with options for a quality fix. Total construction time from start to finish was about 2 weeks.

There was some miss communication and it was unorganized. What should have took a couple of days, took several weeks. The texture they did on the wall was good, but the rest wasn't satisfactory.

"THE CUSTOMER HAD US MAKE SEVERAL CHANGES TO THEIR JOB. AFTER WE INSTALLED THE FRENCH DOOR, THEY HAD NEW CARPET INSTALLED AND THE DOOR WOULD NO LONGER OPEN DUE TO THE HEIGHT. MY COMPANY WENT BACK FOR NO CHARGE AND ADJUSTED THE DOOR. THE COMMUNICATION ISSUES WERE BETWEEN THE HUSBAND AND WIFE. THE PRICE WAS AGREED UPON AND I HAD A SIGNED CONTRACT BEFORE ANY WORK WAS COMPLETED. THE REASON THE JOB TOOK TWO WEEKS IS TO WAIT ON THE HOMEOWNER'S FAMILY TO COME IN AND PAINT BEFORE WE COULD FINISH OUR WORK AND THE DOOR THEY WANTED WAS A SPECIAL ORDER. THE HUSBAND WAS VERY PLEASED WITH THE ENTIRE JOB, THE WIFE WAS ONLY CONCERNED ABOUT PRICE THROUGHOUT THE JOB. I PERSONALLY WENT TO THE JOB AND MADE SURE THEY WERE HAPPY BEFORE MY COMPANY WAS PAID. CHECK MY OTHER REPORT, I DO NOT DO UNSATISFACTORY BUSINESS. THANK YOU, DANIEL AVERY"
