As a result of poor and inadequate advertising, most of my inventory and assets were sold for a fraction of their worth. And a fair amount were not sold at all. In addition to the 30% commission, DAKIL charged me for advertising, hourly wages for his personnel, and a 10% buyers premium which I did not get a percentage of. I received a check for just over $2,000.00, while DAKIL pocketed over $3,500 .00 In the end, about 25% of the items in the auction did not sell, and were left in my building. Of these remaining items, I advertised the most valuable ones (in my opinion) on Craig's list, and sold everything that was advertised. If I had to do over again, I would just advertise everything on Craig's list and not hire any auctioneer. DAKIL made about 150% of what I ended up getting paid. I feel like he did not fulfill his obligation to advertise the auction, and profited excessively at my expense. I should have known, after we signed the contract, he took my hand and said a prayer that the auction would be successful. I do believe in God, but it has been my experience that people who use God to promote their business is a red flag that you are about to be taken for a ride, or entering into a bad deal. Louis Dakil lived the next street over from my house in the 1980s. He sold his house at auction, and I went to the auction just to see how it would go. When he showed the backyard, there was a dog pen with two cages, a gravel floor, and the trash can buried up to the lid for dog waste. It looked like a cruel way to treat animals to me, at night my neighbors and I would hear a dog howling all night long. A week or so before he sold his house, we found a beautiful black lab roaming neighborhood with no tags or ID. I believe this was the dog that he had howling in that horrible piin, removed his collar and turned him loose in the neighborhood. My wife and I took him in and rescued him just before the neighbors called the pound to pick him up. He had clearly been mistreated and abused, but after a few months he turned into a wonderful loving member of our family, extremely protective of my wife and I. How can someone who claims to be a Christian treat an animal this way? I would rate a Dakil's auction service borderline criminal and would never use or recommend them again.
Description of Work: I was closing my business and needed to liquidate all of the assets, both inventory and office equipment. We signed a contract for the auction, and scheduled it for a date earlier than I really wanted (my fault). According to our contract, Louis Dakil, was supposed to "advertise" the auction to people who might be interested in what was being auctioned. All he did was post the auction on his website, and put an ad in the local newspaper under "auctions". My business was for electronic and video equipment sales and services. I know that when I operated my business, I never looked at any auction websites, nor did I look in the newspaper for any. Previously, I had received postcards from Dakil auctioneers anytime there was an auction in my area of equipment that might relate to my business. In response to these postcards, I attended quite a few of his auctions, and purchased equipment that was useful to me at bargain prices. This time, there were no postcards, no phone calls, no communication whatsoever to other businesses listed in the phone book in the same categories where my business was listed. I only found this out late in the afternoon the day before the auction. I made phone calls myself, that accounted for at least one half of the customers who paid a reasonable price for the things I was selling. I believe Dakil advertises to a special group of bargain hunters who come to his auction, knowing that there will be no one there who is really interested in buying the equipment for their own use. The auction participants were mainly resellers, who would market this equipment to customers who should have been notified of my auction.
