Buckeye Landscape Design

I hired David Brown from Buckeye Lanscape Design in November of 2014 to remove a section of concrete, to repair a downspout drainage tile, and to install a retaining wall in our backyard. He started the job around the second week of December, but was unable to remove the concrete due to metal in the concrete. It then got really cold and stated that he would be back in early spring. In early March, he contacted me letting me know that he would be back out in the next few days to begin the work again. He did not show up as stated and I had to contact him asking where he was. This went back and forth for several months. I was given excuse after excuse about why he wasn't showing up. He stated to me that I was his last job that he needed to finish, but why he never was there is beyond me. After constantly contacting him, he finally arrived in late May, removed only a partial of the concrete and once again stated that he would be back to finish. The concrete was finally removed on June 16th, 2015. I mentioned to him that I thought that it would be best if we parted ways and asked for a return of my money of the jobs that hadn't been completed. He stated to me that he would like to finish the job and if he could not, then a return was in order. I gave David Brown another chance. I was told that he would be back over the weekend of July 4th for which he never showed. I was not surprised given his track record. After that weekend, I fired him and told him I wanted my money returned. It is now the middle of September and I have received only 100.00 of our money. He keeps saying that he needs more and more time to get my money back to me. I am seeking legal council at this time.
