"The member contacted our office in regards to her shingles missing due to Hurricane Ike on 9/14/08. We did have winds that gusted up to 85 mph in some areas. She explained that we put her roof on back in 2004 from the hail storm we had in 2003. At the time her roof was installed, my parents owned the company. My father hired a crew to help sell and he received commissions from every job they sold. In 2005, I purchased the business from my parents (the company was not given to me) due to my mother's ailing health, which she passed away not long after I purchased the company from them. This particular crew left town and took the majority of the contracts and contacts with them. So because of this, I did not have a copy of the member's contract in my possession. I asked her if she could make me a copy so I could take a look at it. In the meantime, I went to her property and gave her an estimate. The damage to her roof in mainly at the peak and she has a 14/12 pitch. The winds we experienced that day were gusts of up to 85 mph for at least 5-6 hours. Her roof took a beating from the wind constantly whipping around that area. If she received a 50 year warranty on her shingles and could withstand 110 mph wind, then this would be a manufacturer defect, not a warranty issue. I did not tell the member I would no honor her 5 year labor warranty; I explained this was an act of Mother Nature. I told her that I will still honor her warranty for labor other than an act of Mother Nature. I am not even sure when the contract was signed and what was agreed upon. I am going by her word only. She said there were other neighbors on her street with no damage and their roofs were installed around the same time. When I went out to her property there were other houses on her street with damages. Some areas of town really took a beating by Hurricane Ike. I wanted to clarify that my business cards say Aaron's Roofing because there was a size and space issue by using my full company name. As far as the phone number goes, when I bought the business I kept the phone number. 896-6160 is what is listed on the complaint, which is incorrect. 891-6160 is correct. I really do not think there is anything misleading there. According to her records, her roof was put on between 5-24 and 5-25-2004. If this is the case, I will honor her 5 year labor warranty until that time frame in 2009, for labor issues, not an act of Mother Nature. Again, I do not have a copy of the contract and I am solely going by what she has stated."
