Welles Bowen Realty, Rod Culler and Kevin Smith represented a home seller in January of 2014. The home had an extensive listing with much pertinent information buyers would logically use to assess and evaluate a potential purchase. Within the listing, they listed that the home was "sewer" meaning it was hooked up to Lucas County Sewer, which were available on the street. I accepted the listing as accurate. After the closing, it was discovered that the home is not connected and that it had an obsolete septic system. The upgrade was an immediate $3250 expense. Upon further examination, it was discovered that the Aries listing from the Lucas County Website had the home listed as Septic. It is contended that the erroneous "sewer" listing makes the home a more desirable "sell" for the realtor since a septic system on a street with sewers is likely to be condemned, thus forcing an owner to connect at considerable expense. We further contend that Welles Bowen misrepresented the listing and that, whether intentional or not,, they share in the responsibility of the expense of the sewer tie-in. We have discussed the issue with Welles Bowen. After 4 and a half weeks, they responded that they bear no responsibility for their error and that, through their lawyer, any attempt to pursue the issue will result in legal action AGAINST us. We dealt with Welles Bowen and the seller in good faith. We, like MOST BUYERS, trusted the representations they offered in their listing. It was not accurate. Yet it remains the contention of Welles Bowen that the mistake was ours. I disagree and urge future customers of Welles Bowen to consider our experience before signing any legal contract. They do not accept responsibility for their actions and ultimately may lead to significant added expense when purchasing through them. All that I have offered is accurate and truthful.
