4-16-11: I signed a contract with Jesse Thompson & gave him a $1500.00 deposit (on a $3500 contract) to asphalt & seal my driveway. 5-4-11: I rec'd. a citation from city of Pepper Pike re the driveway which gave me until 7-2-11 to repair. I gave Mr. T. the info & he assured me the job would be done by then. (I asked him to eliminate sealcoat portion of contract because houseowners & contractors told me asphalt should dry for 1-2 yrs. or it will crack under sealcoat.) Starting about the 3rd week in May, I called Mr. T.about once a week & asked when the driveway would be done. At first he told me the asphalt is not available or the 2 companies that sell asphalt would not sell to him or the weather is not right. Then, when I called, he say "maybe Wed.," or "maybe Mon." & then I'd call to verify & again "maybe" whatever. 6-15-11: I spoke to Teresa of the Pepper Pike Bldg. Dept. who advised me to write Mr. T. I wrote & gave him until June 24 to do the work or return my deposit. No response. Teresa, of PP Bldg. Dept. called on 6- 22 & he told her my $$ would be returned by 7-5-11. Mr. Monaco, PP Bldg. Commissioner, called Mr. T. He did not return call. 7-5-11: Mr. T. called me & said he'd give me a check if I signed a release & met him at the Bldg. Dept., 7-7-11, 3:30 p.m. He did not show. Teresa called his cell, told him the dept. closes at 4:pm & arranged for us to meet in Police Dept. He hadn't arrived by 4:15 pm so I Ieft. Home at 4:45 & he called and asked why I hadn't waited for him. He would not bring check to my house. I went to Police Dept., where he had a witness with him & I signed a release saying I wouldn't sue. I had insisted on a cashier's check or money order & he told me he paid $8.00 for it. I asked him why he hadn't done the work and besides the unintelligible mumbling, I heard: "That's business."
